HIGHWAYS, ENGLAND AND WALES

The A65 Trunk Road (Gargrave Bypass) Order 1990 Amendment and New Trunk Road Order 1993

Made 5th July 1993
Coming into force 23rd July 1993

    The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980[1], and now vested in him[2], and of all other enabling powers:—
        1.    The A65 Trunk Road (Gargrave Bypass) Order 1990[3] (hereinafter referred to as "the principal Order") is amended as follows:
       (a) in article 2 of the principal Order for the words "the deposited plan", substitute the words "the deposited plan and the further plan";
       (b) after sub-paragraph (i) in article 4(2) of the principal Order insert the following sub-paragraph—
          "(i) A "the further plan"means the plan numbered HA10/YHCPD59 marked the A65 Trunk Road (Gargrave Bypass) Order 1990 Amendment and New Trunk Road Order 1993, signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;" ;
       (c) in the Schedule to the principal Order—
         (i) for the number "5.4" in line 1, substitute the number "4.9",
         (ii) for the number and words "50 metres east of the British Rail line at Coniston Bridge (marked ‘A’ on the deposited plan)", substitute the number and words—
          "600 metres south of the British Rail line at Coniston Bridge (marked ‘A’ on the further plan) and goes in a south easterly direction to and including a roundabout on the western side of the Trunk Road, then in an easterly direction to the point marked ‘B’ on the further plan. It" .
        2.    So much of the heavy black line on the deposited plan which indicates the centre line of the new trunk road as relates to the length of that road which lies between point ‘A’ on that plan and a point on that road 800 metres east of Coniston Bridge (marked ‘B’ on the further plan) shall be disregarded and in this article "the deposited plan" has the meaning given in the principal Order.
        3.    This Order shall come into force on 23rd July 1993 and may be cited as the A65 Trunk Road (Gargrave Bypass) Order 1990 Amendment and New Trunk Road Order 1993.
