HOUSING, SCOTLAND

The Right to Purchase (Prescribed Persons) (Scotland) Order 1993

Made 28th June 1993
Laid before Parliament 6th July 1993
Coming into force 27th July 1993

    The Secretary of State, in exercise of the powers conferred on him by section 61(11)(w) of the Housing (Scotland) Act 1987[1], and of all other powers enabling him in that behalf, hereby makes the following Order:-
    Citation, commencement and revocation
        1.—(1)  This Order may be cited as the Right to Purchase (Prescribed Persons) (Scotland) Order 1993 and shall come into force on 27th July 1993.

        (2)  The Right to Purchase (Prescribed Persons) (Scotland) Order 1986[2] is hereby revoked.
    Prescribed persons
        2.    The persons listed below and any predecessor of any of those persons are hereby prescribed under section 61(11)(w) of the Housing (Scotland) Act 1987-
      a Government department,

      a Minister of the Crown, other than a Minister specified in paragraph (m), (o), (p), (q), (t) or (v) of section 61(11) of the Housing (Scotland) Act 1987 in relation to a house used for the purpose set out in that paragraph,

      a National Health Service trust,

      the Agriculture and Food Research Council,

      the British Airports Authority,

      the British Coal Corporation,

      the British Gas Corporation,

      the British Railways Board,

      the British Steel Corporation,

      the British Waterways Board,

      the Central Electricity Generating Board,

      the Civil Aviation Authority,

      the Countryside Council for Wales,

      the Electricity Council,

      Highlands and Islands Enterprise,

      the Medical Research Council,

      the National Bus Company,

      the National Rivers Authority,

      the Natural Environment Research Council,

      the Nature Conservancy Council for England,

      the North of Scotland Hydro-Electric Board,

      the Post Office,

      the Science and Engineering Research Council,

      Scottish Natural Heritage,

      the Scottish Sports Council,

      the Scottish Transport Group,

      the South of Scotland Electricity Board,

      the Sports Council,

      the Sports Council for Wales, and

      Waverley Housing Trust Limited.

EXPLANATORY NOTE

(This note is not part of the Order)
    Under the Housing (Scotland) Act 1987 qualification for the right to purchase and entitlement to discount depend inter alia on occupation as a tenant of a house or of a succession of houses provided by the public sector landlords mentioned in section 61(11) of that Act. Paragraph (w) of section 61(11) states that in addition to the persons specifically mentioned in section 61(11) the Secretary of State may prescribe other persons by Order. This Order revokes the previous Order which prescribed "other persons" and prescribes another list of "other persons" which is basically the list in the previous Order with additions and changes bringing that list up to date. As before this Order includes Ministers of the Crown not already mentioned for the specific purposes set out in paragraph (m), (o), (p), (q), (t) or (v) of section 61(11).
