CONSUMER PROTECTION

The Child Resistant Packaging (Safety) (Amendment) Regulations 1993

Coming into force 16th July 1993

    The Secretary of State in exercise of the powers conferred upon him by section 11 of the Consumer Protection Act 1987[1] having consulted such organisations as appear to him to be representative of interests substantially affected by these Regulations, such other persons as he considers appropriate and the Health and Safety Commission, hereby makes the following Regulations:-
        1.    These Regulations may be cited as the Child Resistant Packaging (Safety) (Amendment) Regulations 1993 and shall come into force on 16th July 1993.
        2.    The Child Resistant Packaging (Safety) Regulations 1986[2] shall have effect subject to the following amendments-
       (a) in regulation 3(1)-
         (i) for the word and number "and (5)" there shall be substituted the following ", (5) and (6)";
         (ii) following the word "any" where it first appears there shall be inserted the word "reclosable"; and
         (iii) for "the British Standard Specification for packagings resistant to opening by children BS6652:1989 published by the British Standards Institution on30th June 1989 subject to any further amendments made thereto by the Secretary of State." there shall be substituted the following "the British Standard Specification for child-resistant packaging-requirements and testing procedures for reclosable packages BSEN28317:1993 published by the British Standards Institution on 15 February 1993."; and
       (b) in regulation 3, after paragraph (5) there shall be added the following paragraph:-
        "  (6)  For the purpose of paragraph (1) of this regulation any packaging approved on or before 31st May 1993 by the British Standards Institution as complying with the requirements of the British Standard Specification for packagings resistant to opening by children BS6652:1989 shall be treated as complying in all respects with BSEN28317." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Child Resistant Packaging (Safety) Regulations 1986(S.I. 1986/758) (the 1986 Regulations) as amended by the Child Resistant Packaging (Safety) (Amendment) Regulations 1990 (S.I. 1990/1736) to update the reference to the standard with which packaging must conform. The standard with which the packaging of those products referred to in the Schedule to the 1986 Regulations as regulated products must conform is now the British Standard Specification for packagings resistant to opening by children BSEN28317 published by the British Standards Institution (BSI) on 15th February 1993 (regulation 2(a)(iii)). For the purposes of conforming to the standard it will be sufficient for packaging to conform to BS6652:1989 if it has been approved as so complying by the BSI on or before 31st May 1993 (regulation 2(b)).
    These Regulations also amend regulation 3(1) of the 1986 Regulations by providing that their requirements shall only apply to regulated products supplied in reclosable packaging (regulation 2(b)).
    The British Standards referred to in these Regulations may be obtained from any of the sales outlets operated by the BSI or by post from the Institution at Linford Wood, Milton Keynes, MK14 6LE.
