RESTRICTIVE TRADE PRACTICES

The Registered Restrictive Trading Agreements (Inspection, Copy and Certification) (Fees) Regulations 1993

    The Director General of Fair Trading, in exercise of the powers conferred on him by sections 23 and 27 of the Restrictive Trade Practices Act 1976[1] (hereinafter referred to as "the Act"), hereby makes, with the approval of the Treasury, the following Regulations:
        1.—(1)  These Regulations may be cited as the Registered Restrictive Trading Agreements (Inspection, Copy and Certification) (Fees) Regulations 1993 and shall come into force on 1st July 1993.

        (2)  In these Regulations, "the register" means the register of agreements subject to registration under the Act compiled and maintained by the Director General of Fair Trading in accordance with his duties under section 1(2)(a) of the Act.

        (3)  The Registered Restrictive Trading Agreements (Inspection and Copy) (Fees) Regulations 1977[2] are hereby revoked.
        2.—(1)  Subject to paragraph (2) below, the fee payable by a member of the public for inspecting the register shall be #10.

        (2)  Where a person inspects five or fewer agreements on any one day, the fee shall be #1 in respect of each such agreement.
        3.    The fee for the supply of a copy of, or extract from, any particulars entered or filed on the register shall be 35p for each sheet supplied.
        4.    The fee for the certification by the Director General of Fair Trading of a copy or extract as a true copy of, or extract from, any document entered or filed on the register shall be 35p for each sheet so certified.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations increase the fees payable by members of the public for inspecting agreements placed by the Director General of Fair Trading on the register kept by him under the Restrictive Trade Practices Act 1976, and revoke the Registered Restrictive Trading Agreements (Inspection and Copy) (Fees) Regulations 1977. The fee for inspecting more than five agreements on the register is raised from #1 to #10; where five or fewer agreements on the register are inspected on any one day, the fee is raised from 20p to #1 for each agreement inspected.
    The Regulations also increase the fees for supplying copies of, or extracts from, particulars on the register from 20p to 35p for each sheet so supplied. In addition, they provide for the charging of a fee for the certification by the Director General of Fair Trading of copies of, or extracts from, documents on the register as true copies or extracts. This fee is set at 35p for each sheet so certified.
