ROAD TRAFFIC

The Motor Vehicles (EC Type Approval) (Amendment) Regulations 1993

    The Secretary of State for Transport, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers conferred by that section and of all other enabling powers, hereby makes the following Regulations:-
        1.    These Regulations may be cited as the Motor Vehicles (EC Type Approval) (Amendment) Regulations 1993 and shall come into force on 1st June 1993.
        2.—(1)  Schedule 1 to the Motor Vehicles (EC Type Approval) Regulations 1992[3] shall be amended as follows.

        (2)  In item 1-
       (a) in the third column, there shall be added-
        "92/97/EEC";
       (b) in the fourth column, there shall be added-
        "L371, 19.12.92, p.1".

        (3)  Item 48 shall be re-numbered item 51 and before that item as so re-numbered there shall be inserted the following item-
      50 92/114/EEC L409, 31.12.92, p.17 External projections forward of the cab's rear panel of certain motor vehicles

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend Schedule 1 to the Motor Vehicles (EC Type Approval) Regulations 1992. The 1992 Regulations implemented Council Directive 92/53/EEC which relates to the type approval of motor vehicles and their trailers.
    These Regulations are made in consequence of Council Directives 92/97 EEC and92/114/EEC.
    Council Directive 92/97/EEC further amends Council Directive 70/157/EEC which relates to the permissible sound level and exhaust systems of motor vehicles. Council Directive 92/114/EEC relates to the external projections forward of the cab's rear position panel of motor vehicles of category N.
    The item numbers in the Schedule as amended reflect the item numbers in Annex IV to Council Directive 92/53 EEC. At present no Directives have been issued in connection with the subject matter of items 48 or 49 of Annex IV to Directive 70/156/EEC as amended by Directives 87/403/EEC and 92/53/EEC. Consequently there are no entries in items 48 and 49 of the Schedule.
    Copies of the EC Directives which are relevant to these Regulations can be obtained from Her Majesty's Stationery Office. The details of the Directives are set out below.
