SOCIAL SECURITY

The Social Security (Claims and Payments) Amendment (No. 2) Regulations 1993

Coming into force 12th May 1993

    The Secretary of State for Social Security, in exercise of the powers conferred by section 5(1)(i) and 189(4) and (6) of the Social Security Administration Act 1992[1] and of all other powers enabling him in that behalf, after agreement by the Social Security Advisory Committee that the proposals to make these Regulations need not be referred to it[2], hereby makes the following Regulations:
    Citation, commencement and interpretation
        1.—(1)  These Regulations, which may be cited as the Social Security (Claims and Payments) Amendment (No. 2) Regulations 1993, shall come into force on 12th May 1993.

        (2)  In these Regulations, unless the context otherwise requires, any reference to a numbered paragraph, regulation or Schedule is a reference to the paragraph, regulation or Schedule bearing that number in the Social Security (Claims and Payments) Regulations 1987[3].
    Amendment of Regulation 21
        2.    In Regulation 21 (direct credit transfer)-
       (a) at the beginning of paragraph (3) there shall be inserted the words "Subject to paragraph (3A)";
       (b) after paragraph (3) there shall be inserted the following paragraph-
        "  (3A)  Income Support shall be paid in accordance with paragraph (1) within 7 days of the time determined for the payment of income support in accordance with Schedule 7." ;
       (c) in paragraph (4) after the words "paragraph (3)" there shall be inserted the words "or (3A)";
       (d) in paragraph (6) after the words "family credit" there shall be inserted the words "unemployment benefit, income support, sickness benefit, invalidity benefit, severe disablement allowance".
        3.    In regulation 26(1) (income support) for the words "Schedule 7" there shall be substituted the words "Subject to regulation 21 (direct credit transfer), Schedule 7".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend section 21 of the Social Security (Claims and Payments) Regulations 1987 ("the Claims and Payments Regulations") by extending the class of benefits which may be paid by automated credit transfer into a bank or other account.
    Regulation 2 amends regulation 21 of the Claims and Payments Regulations by adding paragraph (3A) which provides for the time when income support paid by automated credit transfer shall be paid and makes consequential amendments to paragraphs (3) and (4).
    Regulation 2(d) amends regulation 21(6) of the Claims and Payments Regulations by adding unemployment benefit, income support, sickness benefit, invalidity benefit and severe disablement allowance to the benefits which may be paid by automated credit transfer.
    Regulation 3 amends regulation 26(1) of the Claims and Payments Regulations in consequence of the addition of regulation 21(3A).
