The Local Government Administration (Matters Subject to Investigation) Order 1993

Present,

The Queen's Most Excellent Majesty in Council

    Her Majesty, by virtue of and in exercise of the powers conferred on Her by section 26(9) of the Local Government Act 1974[1], is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:
    Citation and commencement
        1.    This Order may be cited as the Local Government Administration (Matters Subject to Investigation) Order 1993 and shall come into force on 28th April 1993.
    Matters ceasing to be excluded from investigation
        2.    With a view to matters relating to-
       (a) the grant, renewal or revocation of a licence to occupy a pitch or stall in a fair or market, or the attachment of any condition to such a licence, and
       (b) the provision (other than in connection with a dock or harbour undertaking) of moorings,
    ceasing to be excluded by virtue of Schedule 5 to the Local Government Act 1974 from the matters subject to investigation by a Local Commissioner, paragraph 3 of that Schedule shall be amended as follows:
       (i) in sub-paragraph (2), at the end there shall be inserted "other than transactions relating to the grant, renewal or revocation of a licence to occupy a pitch or stall in a fair or market, or the attachment of any condition to such a licence", and
       (ii) in sub-paragraph (3)(a), after "disposal of land" there shall be inserted "or the provision of moorings (not being moorings provided in connection with a dock or harbour undertaking)".

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends Schedule 5 to the Local Government Act 1974 so that action taken in connection with transactions relating to either-
      (a) the grant, renewal or revocation of a licence to occupy a pitch or stall in a fair or market, or the attachment of any condition to such a licence, or
      (b) the provision of moorings other than in connection with a dock or harbour undertaking,
    ceases to be excluded from investigation by a Commissioner for Local Administration.
