LOCAL GOVERNMENT, ENGLAND AND WALES

CHANGES IN LOCAL GOVERNMENT AREAS

The Greater Manchester and Lancashire (County and Metropolitan Borough Boundaries) Order 1993

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972^[1] and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:

Citation and commencement
    1.—(1)  This Order may be cited as the Greater Manchester and Lancashire (County and Metropolitan Borough Boundaries) Order 1993.

    (2)  This Order shall come into force on 1st December 1993 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976^[2].

    (3)  For all other purposes, this Order shall come into force on 1st April 1994.

Interpretation
    2.    In this Order—
"district" includes a borough, a metropolitan borough;


"electoral division" means an electoral division of the county of Lancashire^[3];


"Greater Manchester" means the metropolitan county of Greater Manchester, and any reference to Bury or to Rochdale is a reference to the district of that name in that county;


"Lancashire" means the county of Lancashire, and any reference to Rossendale is a reference to the district of that name in that county;


"the map" means one of the 3 maps prepared by the Department of the Environment, marked "Maps of the Greater Manchester and Lancashire (County and Metropolitan Borough Boundaries) Order 1993", and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976; and


"ward" means a ward of the district from or to which an area is transferred by this order^[4], except in the expression "parish ward", where it means a ward of the parish to which an area is transferred.

Transfers from Greater Manchester (Rochdale) to Lancashire (Rossendale)
    3.    The areas which are marked C1 and C2 on map 1 shall be transferred from Greater Manchester, from Rochdale, and from the Healey ward to—
 (a) Lancashire;
 (b) Rossendale;
 (c) the parish of Whitworth, and the Healey parish ward;
 (d) the Healey and Whitworth ward, and the Whitworth electoral division; and to
 (e) the Rossendale petty sessional division, and the East Lancashire coroner's district.

Transfers within Greater Manchester between Bury and Rochdale
    4.—(1)  The areas which are marked B1 and B4 on map 2 and B5 on map 3 shall be transferred from Bury, and from the Holyrood ward to Rochdale, and to the Middleton and Heywood petty sessional division.The areas marked B1 and B4 shall additionally be transferred to the Middleton South ward, and the area marked B5 to the Middleton West ward.

    (2)  The areas which are marked B2 and B3 on map 2 and B6 and B7 on map 3 shall be transferred from Rochdale, and from the Middleton South ward to Bury, to the Holyrood ward, and to the Bury petty sessional division.

Town and Country Planning
    5.—(1)  In this article, "provision" means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990^[5]).

    (2)  Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

This Order makes minor realignments in the boundary between Greater Manchester (Rochdale) and Lancashire (Rossendale).

Two small unpopulated areas of land (totalling approximately 0.25 hectares) are transferred to Lancashire, to Rossendale, and to the parish of Whitworth.

They are located in the vicinity of Market Street and Whitworth Road, to the north of Christ Church, Middle Healey and south of White Hill.

The Order also makes minor realignments within Greater Manchester to the boundary between the metropolitan boroughs of Bury and Rochdale.

The relevant part of the boundary stretches from the northern end of Bowlee southwards along Heywood Old Road and Middleton Road to the River Irk, near the boundary with the city of Manchester.

In total, approximately 2 hectares of land and 42 inhabitants are affected by these changes.

Consequential changes to local government electoral areas, petty sessional divisions and coroners' districts are made.

Only one parish is affected, that of Whitworth (in Lancashire).

This Note is a general guide only to the areas affected, and the maps described in article 2 should be inspected for full details of the transfers.

Any person may inspect the maps at all reasonable times at the offices of the council for each borough affected, and additionally at the offices of the Secretary of State for the Environment located in 2, Marsham Street, London SW1P 3EB.

The Local Government Area Changes Regulations 1976 contain general provisions regarding the effect of orders such as this one.
