The Education (Designated Institutions in Further and Higher Education) (Interpretation) (Amendment) Order 1993

Coming into force 19th April 1993

    In exercise of the powers conferred on the Secretary of State by sections 90(2) and 89(4) of the Further and Higher Education Act 1992[1] the Secretary of State for Education, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Order:
    Citation and Commencement
        1.    This Order may be cited as the Education (Designated Institutions in Further and Higher Education) (Interpretation) (Amendment) Order 1993 and shall come into force on 19th April 1993.
    Interpretation of references to governing bodies
        2.    The Education (Designated Institutions in Further and Higher Education) (Interpretation) Order 1993[2] shall be amended by the insertion in Schedule 1 thereto (references to be read as references to the company) of the following additional references—
    Place to be inserted Additional reference
    after the Education Reform Act 1988[3], section 133 the Education Reform Act 1988, section 135(2)
    after the Further and Higher Education Act 1992, section 48 the Further and Higher Education Act 1992, section 53(2).

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends the Education (Designated Institutions in Further and Higher Education) (Interpretation) Order 1993 (S.I. 1993/563). It inserts into Schedule 1 to that Order (references to governing bodies of designated institutions that are companies to be read as references to the company) references to section 135 of the Education Reform Act 1988 and section 53 of the Further and Higher Education Act 1992. These sections both relate to the inspection of accounts by the Comptroller and Auditor General.
