The Health and Safety (Miscellaneous Modifications) Regulations 1993

Made 15th March 1993

Coming into force 14th April 1993

    The Secretary of State, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the abolition of restrictions on the import and export of goods, in exercise of the powers conferred on her by that subsection and of all other powers enabling her in that behalf, hereby makes the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Health and Safety (Miscellaneous Modifications) Regulations 1993 and shall come into force on 14th April 1993.
    Modifications to the Anthrax Prevention Order 1971
        2.    Articles 4 and 5 of the Anthrax Prevention Order 1971[3] (which impose restrictions on the importation of certain goods into Great Britain) shall cease to have effect insofar as they relate to the importation of those goods into that country from any member State.
    Modifications to the Control of Substances Hazardous to Health Regulations 1988
        3.—(1)  Regulation 4(2) of the Control of Substances Hazardous to Health Regulations 1988[4] (which prohibits the importation of certain substances and articles into the United Kingdom) shall cease to have effect insofar as it relates to the importation of those substances and articles into that country from any member State.

        (2)  Regulation 4(3) of the Control of Substances Hazardous to Health Regulations 1988 (which prohibits the supply of certain substances and articles) shall be modified by substituting the words "specified in paragraph (2)" for the words "the importation of which is prohibited by paragraph (2)".

EXPLANATORY NOTE

(This note is not part of the Regulations)
        1.    These Regulations modify-
      (a) the Anthrax Prevention Order 1971 (S.I. 1971/1234) by revoking Articles 4 and 5 thereof (which impose restrictions on the importation of certain goods into Great Britain) insofar as those Articles relate to the importation of those goods into that country from member States of the Communities referred to in section 1(2) of the European Communities Act 1972 (1972 c. 68); and
      (b) the Control of Substances Hazardous to Health Regulations 1988 ("the 1988 Regulations") (S.I. 1988/1657) by revoking regulation 4(2) thereof (which prohibits the importation of certain substances and articles into the United Kingdom) insofar as that paragraph relates to the importation of those substances and articles into that country from member States of the Communi ties referred to above.

        2.    These Regulations also make a consequential modification to regulation 4(3) of the 1988 Regulations.
        3.    The modifications referred to above are some of the measures necessary for the establishment of the internal market as required by Article 8A of the Treaty establishing the European Economic Community.
