LANDLORD AND TENANT, ENGLAND AND WALES

The Rent Book (Forms of Notice) (Amendment) Regulations 1993

Coming into force 1st April 1993


    The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred upon them by section 5 of the Landlord and Tenant Act 1985[1] and of all other powers enabling them in that behalf, hereby make the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Rent Book (Forms of Notice) (Amendment) Regulations 1993 and shall come into force on 1st April 1993.
    Amendment of forms
        2.    The forms in the Schedule to the Rent Book (Forms of Notice) Regulations 1982[2] are amended as follows—

      (a)  in paragraph 4 of the forms in Parts I, II, III and IV—

        (i)  for "including/excluding rates" substitute—
          "[**including council tax] [*** and including rates]";

        (ii)  add the following footnotes—

            "** Cross out if council tax is not payable to the landlord.

            *** Cross out if rates are not payable to the landlord.

        (iii)  omit the note "Dagger Cross out whichever does not apply.";

      (b)  in paragraph 5 of the forms in Parts I, II and III after "rates" insert ", but includes any council tax payable to the landlord".

EXPLANATORY NOTE

(This note is not part of the Regulations)

    These Regulations amend forms of notice (prescribed by the Rent Book (Forms of Notice) Regulations 1982) which must be inserted in rent books or similar documents under section 5 of the Landlord and Tenant Act 1985. The amendments are consequential on the introduction of council tax and are to the forms relating to restricted contracts, regulated tenancies and tenancies under the Rent (Agriculture) Act 1976, and assured tenancies or assured agricultural occupancies.
