The Bovine Animals (Identification, Marking and Breeding Records) (Amendment) Order 1993

Made 8th March 1993
Coming into force 9th March 1993

    The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 1, 8(1) and 72 of the Animal Health Act 1981[1], and of all other powers enabling them in that behalf, hereby make the following Order:—
    Title and commencement
        1.    This Order may be cited as the Bovine Animals (Identification, Marking and Breeding Records) (Amendment) Order 1993 and shall come into force on 9th March 1993.
    Amendment
        2.    The Bovine Animals (Identification, Marking and Breeding Records) Order 1990[2] shall be amended as follows—
       (a) for article 9 there shall be substituted the following articles—

          "Records of bovine animals
              9.—(1)  The owner or person in charge of bovine animals shall keep a record in the form set out in the Schedule to this Order or in a form to the like effect of
            (a) the particulars of each bovine animal as specified in the several columns in that form, and
            (b) the number of bovine animals present on the holding.

              (2)  Where the entry relates to the birth of a bovine animal, the entry shall be made, in the case of a birth in a dairy herd, within 36 hours of the birth and in any other case within 7 days of the birth.

              (3)  Where the entry relates to the death of a bovine animal, the entry shall be made within 7 days of the death.

              (4)  Every record made under this Order shall be retained by the owner or person in charge of the holding for a period of 10 years from the date of the birth or death recorded.

              (5)  Any person who is for the time being in charge of any record required to be made under this Order shall, on demand made by an inspector at any reasonable hour, produce the record and allow a copy to be made of it or an extract to be taken from it or (in the case of a computerised record) produce a printout of it.


          Records of holdings
              9A.—(1)  The owner or person in charge of any bovine animals shall notify in writing the Animal Health Office for the area in which the animals are kept of
            (a) the name and address of the owner or occupier of the holding on which the animals are kept, and
            (b) any change in the information supplied under paragraph (a) above.

              (2)  Notification under paragraph (1) above shall be made by 1st May 1993 and thereafter within one month of the change required to be notified." ;

       (b) for the Schedule there shall be substituted the provisions of the Schedule to this Order.
