The Local Government Finance Act 1992 (Community Charge Benefits) Saving Order 1993

Coming into force 31st March 1993

    The Secretary of State for Social Security in exercise of powers conferred on him by section 114 of the Local Government Finance Act 1992[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation, commencement and interpretation
        1.—(1)  This Order may be cited as the Local Government Finance Act 1992 (Community Charge Benefits) Saving Order 1993 and shall come into force on 31st March 1993.

        (2)  In this Order "community charge benefits" means the benefits so named to which section 63 of the Social Security Administration Act 1992[2] as originally enacted refers.
    Saving
        2.    Notwithstanding the amendment made by paragraph 14(2) of Schedule 9 to the Local Government Finance Act 1992 in section 63(3) of the Social Security Administration Act 1992[3], that provision shall have effect as originally enacted in respect of community charge benefits in relation to any year which ends or ended before 1st April 1993; and accordingly (but without prejudice to the generality of the foregoing provisions) in relation thereto the powers conferred by the said section 63(3) on the Secretary of State to make provision by regulation for reviews of determinations relating to community charge benefits may be exercised as if that amendment had not been made.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order provides that, notwithstanding the amendment made to section 63(3) of the Social Security Administration Act 1992 by paragraph 14 of Schedule 9 to the Local Government Finance Act 1992, which replaces the reference to community charge benefits by a reference to council tax benefit, the power conferred by that section to make regulations for reviews of determinations relating to community charge benefits in relation to any year which ends before 1st April 1993, may be exercised as if the amendment referred to had not been made.
