EDUCATION, ENGLAND AND WALES

The Education (Designated Institutions in Further Education) Order 1993

Made 2nd March 1993
Laid before Parliament 9th March 1993
Coming into force 1st April 1993

    The Secretary of State for Education in exercise of the powers conferred by sections 28, 29(1)(b), 32 and 33 of the Further and Higher Education Act 1992[1] hereby makes the following Order:
        1.—(1)  This Order may be cited as the Education (Designated Institutions in Further Education) Order 1993 and shall come into force on 1st April 1993.

        (2)  In this Order a reference to a section is a reference to a section of the Further and Higher Education Act 1992.
        2.    The institutions specified in Schedule 1 to this Order, being educational institutions of the kinds described in subsections (1) and (2) of section 28, are hereby designated as institutions eligible to receive support from funds administered by the Further Education Funding Council for England or the Further Education Funding Council for Wales.
        3.    Section 29 (government and conduct of designated institutions) shall not apply to the Workers' Educational Association.
        4.—(1)  Section 32 (transfer of property, etc., to designated institutions) shall have effect in relation to the institutions specified in column (1) of Schedule 2 to this Order.

        (2)  The persons specified in column (2) of Schedule 2 to this Order are hereby specified as being persons appearing to the Secretary of State to be trustees holding property for the purposes of the respective institutions specified opposite them in column (1) of that Schedule.

        (3)  Where a trust deed is specified in column (3) of Schedule 2 to this Order, property or rights transferred to the persons specified opposite that deed in column (2) of that Schedule shall be held on the trusts applicable under that deed.
