CHANGES IN LOCAL GOVERNMENT AREAS

The Cheshire and Merseyside (County and Metropolitan Borough Boundaries) Order 1993

Coming into force for
  the purposes referred to in article 1(2) 1st December 1993
  for all other purposes 1st April 1994


    The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972[1] and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:
    Citation and commencement
        1.—(1)  This Order may be cited as the Cheshire and Merseyside (County and Metropolitan Borough Boundaries) Order 1993.

        (2)  This Order shall come into force on 1st December 1993 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976[2].

        (3)  For all other purposes, this Order shall come into force on 1st April 1994.
    Interpretation
        2.    In this Order-
      "Cheshire" means the county of Cheshire, and any reference to Halton is a reference to the Cheshire borough of that name;

      "electoral division" means an electoral division of Cheshire[3];

      "the map" means one of the 6 maps prepared by the Department of the Environment, marked "Maps of the Cheshire and Merseyside (County and Metropolitan Borough Boundaries) Order 1993", and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

      "Merseyside" means the metropolitan county of Merseyside, "Liverpool" means the city of Liverpool in that county, and "Sefton" means the metropolitan borough of Sefton in that county;

    any reference to an area as unparished is a reference to that area not forming part of any parish; and
      "ward" means a ward of the borough, city or metropolitan borough from or to which an area is transferred[4].

    Transfers from Merseyside (Liverpool) to Cheshire (Halton)
        3.    The following unparished areas of Merseyside, and of Liverpool, which are shown on map 1-

      (a)  the part of the Speke ward marked A; and

      (b)  the part of the St. Mary's ward marked B-
    shall be transferred to Cheshire, to Halton, to the parish and ward of Hale, to the Oakfield electoral division, and to the Halton petty sessional division and the Cheshire coroner's district.
    Transfers within Merseyside between Liverpool and Sefton
        4.—(1)  Each unparished area which is marked as shown on the following Table on the map indicated in column 2 shall be transferred from Liverpool, and from the ward named in column 3 to Sefton, to the parish (if any) and the ward named in column 4, and to the South Sefton petty sessional division and the Knowsley, St. Helens and Sefton coroner's district.

        (2)  Each area which is marked as shown on the following Table on the map indicated in column 2 shall be transferred from Sefton, and from the parish (or, where unparished, the ward) named in column 3 to Liverpool, to the ward named in column 4, and to the Liverpool Metropolitan District petty sessional division and the Liverpool coroner's district, remaining or becoming unparished.     Town and country planning
        5.—(1)  In this article, "provision" means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990[5]).

        (2)  Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

EXPLANATORY NOTE

(This note is not part of the Order)

    This Order makes small changes to the boundary of the county of Cheshire (borough of Halton) with the metropolitan county of Merseyside (city of Liverpool). It also transfers small areas within Merseyside between Liverpool and the metropolitan borough of Sefton.
    The map and table forming part of this note (Pages 4 and 5) give a general guide to the areas affected, and their approximate size and population. Prints of the detailed maps (described in article 2) may be inspected at all reasonable times at the offices of the council for each borough or city affected, and additionally at the offices of the Secretary of State for the Environment located in 2, Marsham Street, London SW1P 3EB.
    The Local Government Area Changes Regulations 1976 contain general provisions regarding the effect of orders such as this one.
    TABLE OF CHANGES EFFECTED
    Transfers from Merseyside (Liverpool) to Cheshire (Halton) Article 3 Area (total): 55 hectares Population (total): 135 Transfer of area at Hale Heath, located east of Liverpool Airport, and bounded by Dungeon Lane in the west, the River Mersey in the south, and by Hale Road and the southern curtilage of St. Ambrose School and Playing Field in the north. Area includes Ashton's Lane, Bailey's Lane and part of Hale Road.
    Transfers within Merseyside between Liverpool and Sefton Article 4Transferred from Liverpool- Area: 6 hectares Population: 7 Transferred to Liverpool- Area: 7 hectares Population: 285
      Realignments as follows-

        (a)  at Canada Dock/Regent Road/Dacre Street/Bedford Place/Brasenose Road/St. Johns Road;

        (b)  Antonio Street/Cassio Street/Brewster Street;

        (c)  Bedford Road/Southport Road;

        (d)  in Backhouse Walk/Stuart Street;

        (e)  on southern side of Aintree Race Course between Seeds Lane and Sherwoods Lane; and

        (f)  Between Orrell Lane and Warbreck Heath, affecting properties in Bull Lane and related development, Cambridge Road, Oxford Road and Ashcroft Road.
