CHANGES IN LOCAL GOVERNMENT AREAS

The Hereford and Worcester and Warwickshire (County Boundaries) Order 1993

Made 16th February 1993
Laid before Parliament 26th February 1993
Coming into force for
  the purposes referred to in article 1(2) 1st December 1993
  for all other purposes 1st April 1994

    The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972[1] and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect, with modifications, to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:
    Citation and commencement
        1.—(1)  This Order may be cited as the Hereford and Worcester and Warwickshire (County Boundaries) Order 1993.

        (2)  This Order shall come into force on 1st December 1993 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976[2].

        (3)  For all other purposes, this Order shall come into force on 1st April 1994.
    Interpretation
        2.    In this Order—
      "district" includes a borough;
      "electoral division" means an electoral division of the county to which an area is transferred by this order;
      "Hereford and Worcester" means the county of Hereford and Worcester, and any reference to Bromsgrove, to Redditch, or to Wychavon is a reference to the district of that name in that county;
      "map" means one of the 3 maps prepared by the Department of the Environment, marked
      "Maps of the Hereford and Worcester and Warwickshire (County Boundaries) Order 1993", and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;
      "ward" means a ward of the district to which an area is transferred by this order; and
      "Warwickshire" means the county of Warwickshire, and any reference to Stratford-on-Avon is a reference to the Warwickshire district of that name.

    Transfers from Hereford and Worcester to Warwickshire
        3.    Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Hereford and Worcester, and from the district and the parish named in column 3 to—
       (a) Warwickshire;
       (b) Stratford-on-Avon;
       (c) the parish, ward and electoral division mentioned in column 4; and to
       (d) the South Warwickshire petty sessional division and the Warwickshire coroner's district.

        4.    Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Warwickshire, from Stratford-on-Avon, and from the parish named in column 3 to—
       (a) Hereford and Worcester;
       (b) the district, parish (if any), ward and electoral division mentioned in column 4; and to
       (c) the Bromsgrove and Redditch petty sessional division and the North Eastern Hereford and Worcester coroner's district.

    Town and country planning
        5.—(1)  In this article, "provision" means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990[3]).

        (2)  Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order makes changes in the boundary between the county of Herefordand Worcesterand the county of Warwickshire, affecting the districts of Bromsgrove, Redditchand Wychavon in Herefordand Worcesterand the district of Stratford-on-Avon in Warwickshire. Consequential changes to local government electoral areas, petty sessional divisionsand coroners' districts are made.
    The map and table forming part of this Note are a general guide only to the areas affected. The table gives in approximate terms the hectarage and population affected by the transfers. The maps described in article 2 should be inspected for full details of the transfers. Any person may inspect the maps at any reasonable time at the offices of each district council whose area is affected, and additionally at the offices of the Secretary of State for the Environment located in 2 Marsham Street, London SW1P 3EB.
    The Local Government Area Changes Regulations 1976 contain general provisions regarding the effect of orders such as this one.

    Transfers from Hereford and Worcester to Warwickshire (Stratford-on-Avon)—article 3.
    Area: 190 hectares           Population: 80
    General description of transfers
        1.    Transfer from Bromsgrove (Beoley) to Tanworth-in-Arden of large area to the east of Alcester Road, starting to the north of Branson's Cross and running to the south of Gorcott Hill. Area includes Alderhanger Farm, part of Alderhanger Lane, Brooklands Farm, Tanworth Lane, Cottage Farm and Park Farm.
        2.    Transfer from Wychavon (Pebworth) to Long Marston of area of Ministry of Defence land, located to the north of Jordans Farm and Boundary View, and to the south of the Central Engineer Park.

    Transfers from Warwickshire (Stratford-on-Avon) to Hereford and Worcester—article 4.
    Area: 70 hectares           Population: 210
    General description of transfers
        1.    Transfer from Tanworth-in-Arden to Bromsgrove (Beoley) of area including part of Alcester Road (A435) and properties to the west of that road, starting at the Horse and Jockey Inn, and running to the vicinity of the White Lion Public House. Area includes Dumble Pit Lane, the Portway area, and the Rose and Crown Public House.
        2.    Transfer from Studley to Redditch of area in vicinity of Pipers Road, to unite Redditch Park Farm Industrial Estate in Hereford and Worcester.
