EDUCATION, ENGLAND AND WALES

The Education (Further Education Corporations) Order 1993

Made 17th February 1993
Laid before Parliament 26th February 1993
Coming into force 1st April 1993

    Whereas the Secretary of State for Education, in accordance with section 51(3) of the Further and Higher Education Act 1992[1] and regulation 6 of the Education (Publication of Draft Proposals and Orders) (Further Education Corporations) Regulations 1992[2], published a draft of this Order by the time and in the manner prescribed by that regulation;
    Now therefore, in exercise of the powers conferred on him by sections 16(1) and 17 of that Act, the Secretary of State for Education hereby makes the following Order:
        1.    This Order may be cited as the Education (Further Education Corporations) Order 1993 and shall come into force on 1st April 1993 ("the Commencement Date").
        2.    On the Commencement Date there shall be established a body corporate called "St Austell College" for the purpose of establishing and conducting from the operative date a new educational institution of that name (to be formed by the merger of St Austell Sixth Form College and Mid-Cornwall College).
        3.    The "operative date", in relation to the further education corporation established by this Order and the institution it is to conduct, shall be 2nd April 1993.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order establishes a further education corporation under section 16(1) of the Further and Higher Education Act 1992 for the purpose of establishing and conducting St Austell College and appoints 2nd April 1993 as the "operative date" for the purposes of Part I of that Act.
