NORTHERN IRELAND

The Aircraft and Shipbuilding Industries (Repeals) (Northern Ireland) Order 1992

Made 9th February 1993
Coming into Operation 10th April 1993

At the Court at Buckingham Palace, the 9th day of February 1993

The Queen's Most Excellent Majesty in Council

    Whereas a draft of this Order has been approved by a resolution of each House of Parliament:
    Now, therefore, Her Majesty, in exercise of the powers conferred by paragraph 1 of Schedule 1 to the Northern Ireland Act 1974[1] and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—
    Title and commencement
        1.—(1)  This Order may be cited as the Aircraft and Shipbuilding Industries (Repeals) (Northern Ireland) Order 1993.

        (2)  This Order shall come into operation on the expiration of two months from the day on which it is made.
    Interpretation
        2.—(1)  The Interpretation Act (Northern Ireland) 1954[2] shall apply to Article 1 and the following provisions of this Order as it applies to a Measure of the Northern Ireland Assembly.

        (2)  In this Order—
      "the Department" means the Department of Economic Development;
      "the Order of 1979" means the Aircraft and Shipbuilding Industries (Northern Ireland) Order 1979[3].

    Termination of financial assistance to Short Brothers PLC
        3.    No further financial assistance shall be given to Short Brothers PLC by the Department under the Order of 1979 and accordingly in Article 2(2) of the Order of 1979 in the definition of "the principal companies" sub-paragraph (b) is hereby repealed.
    Termination of certain duties of the Department under the Order of 1979
        4.    The Department shall not, in relation to Harland and Wolff PLC—
       (a) give directions of a general character;
       (b) require information to be furnished to the Department;
       (c) review performance;
       (d) encourage industrial democracy; or
       (e) consult with United Kingdom Government Departments with regard to any measures relating to the co-ordination of activities between certain companies,
    and accordingly Articles 6, 7, 8 and 10 of the Order of 1979 are hereby repealed.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order repeals the Aircraft and Shipbuilding Industries (Northern Ireland) Order 1979 in so far as it provides for financial assistance to Short Brothers PLC and in respect of certain duties of the Department of Economic Development in relation to Harland and Wolff PLC.
    The repeal of the Aircraft and Shipbuilding Industries (Northern Ireland) Order 1979 in its application to Short Brothers PLC is consequential on the reorganization of the aircraft and shipbuilding industries. In future Short Brothers PLC will receive financial assistance under the Industrial Development (Northern Ireland) Order 1982.
