NATIONAL HEALTH SERVICE, ENGLAND AND WALES

The Barnsley Community and Priority Services National Health Service Trust (Transfer of Trust Property) Order 1993

Laid before Parliament 5th February 1993
Coming into force 26th February 1993

    The Secretary of State for Health, in exercise of the powers conferred on her by section 92(1) of the National Health Service Act 1977[1] and of all other powers enabling her in that behalf, having regard to the change in the arrangements for the administration of hospitals and facilities formerly managed by Barnsley Health Authority resulting from the establishment of the Barnsley Community and Priority Services National Health Service Trust[2], having consulted that Health Authority and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:
    Citation, commencement and interpretation
        1.—(1)  This Order may be cited as the Barnsley Community and Priority Services National Health Service Trust (Transfer of Trust Property) Order 1992 and shall come into force on 26th February 1993.

        (2)  In this Order—
      "the Authority" means Barnsley Health Authority;

      "the Trust" means the Barnsley Community and Priority Services National Health Service Trust;

      "the trust property" means the items specified in a schedule of trust property prepared by and agreed upon by the Authority and the Trust on 6th November 1992, which schedule has been signed on behalf of both the Authority and the Trust.

    Transfer of trust property
        2.    On 26th February 1993 the trust property shall be transferred from the Authority to the Trust.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order transfers to the Barnsley Community and Priority Services National Health Service Trust on 26th February 1993 trust property formerly held by Barnsley Health Authority. A copy of the schedule of trust property to which the Order refers can be obtained at the Department of Health, National Health Service Trust Unit, 4N34A Quarry House, Quarry Hill, Leeds LS1 7UH.
