EDUCATION, ENGLAND AND WALES

The Education (Higher Education Corporations) (Wales) (No. 3) Order 1993

Made 12th January 1993
Laid before Parliament 15th January 1993
Coming into force 5th February 1993

    In exercise of the powers conferred on the Secretary of State by sections 122, 123(4) and 126(2) of the Education Reform Act 1988[1], the Secretary of State for Wales hereby makes the following Order:—
        1.    This Order may be cited as the Education (Higher Education Corporations) (Wales) (No.3) Order 1993 and shall come into force on 5th February 1993.
        2.    There shall be established as from 6th February 1993, a body corporate by the name of the North East Wales Institute of Higher Education Higher Education Corporation to conduct, as from 1st April 1993, the institution known as the North East Wales Institute of Higher Education, being an institution which appears to the Secretary of State to satisfy the criteria set out in section 122(1) of the Education Reform Act 1988.
        3.    1st April 1993 is hereby appointed as the transfer date for the said body corporate for the purposes of section 126 of the Act.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order makes provision, under Section 122 of the Education Reform Act 1988, for the establishment of a body corporate to conduct the North East Wales Institute of Higher Education. The new body, which will have the name of the North East Wales Institute of Higher Education Higher Education Corporation, is established on 6th February 1993 to prepare itself for the conduct of that institution from 1st April 1993, which is appointed as the transfer date for the purpose of section 126 of that Act.

[1] 1988 c. 40; sections 122(2) to (5), and section 227(2) (which provides that section 122 shall not apply in relation to Wales) were repealed by, respectively, paragraphs 31 and 54 of schedule 8 to the Further and Higher Education Act 1992 (c. 13). Section 123(4) was substituted by paragraph 32 of Schedule 8 to that Act. back
