PLANT HEALTH

The Plant Health (Forestry) (Great Britain) (Amendment) Order 1992

Made 16th December 1992
Laid before Parliament 21st December 1992
Coming into force 1st January 1993

    The Forestry Commissioners, in exercise of the powers conferred on them by sections 1(2)(a), 2 and 3 of the Plant Health Act 1967([1]) as read with section 20 of the Agriculture (Miscellaneous Provisions) Act 1972([2]), and of all other powers enabling them in that behalf, hereby make the following Order:
    Title and commencement
        1.    This Order may be cited as the Plant Health (Forestry) (Great Britain) (Amendment) Order 1992 and shall come into force on 1st January 1993.
    Amendment of the Plant Health (Forestry) (Great Britain) Order 1989
        2.    The Plant Health (Forestry) (Great Britain) Order 1989([3]) shall be amended in accordance with article 3 below.
        3.    At the end of article 9 there shall be added the following paragraph:
      "  (8)  Paragraphs (5) and (7) of this article shall not apply to any consignment of or, as the case may be, any phytosanitary certificate, reforwarding phytosanitary certificate or mill certificate in respect of any tree, wood, isolated bark, soil or growing medium which is directly consigned to Great Britain from a Member State." .

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order further amends the Plant Health (Forestry) (Great Britain) Order 1989. The Order removes the requirement for phytosanitary and similar certificates, accompanying consignments of trees, wood, isolated bark, soil or growing medium introduced into Great Britain directly from other Member States of the European Community, to be delivered to or be delivered to or be endorsed by the customs authorities.
