The Local Government Act 1988 (Defined Activities) (Competition) (Tunbridge Wells Borough Council) Regulations 1992

    The Secretary of State, in exercise of the powers conferred on him by sections 6(3) and 15(6) of the Local Government Act 1988[1], and of all other powers enabling him in that behalf, hereby makes the following Regulations:
    Citation, commencement and interpretation
        1.—(1)  These Regulations may be cited as the Local Government Act 1988 (Defined Activities) (Competition) (Tunbridge Wells Borough Council) Regulations 1992 and shall come into force on 1st January 1993.

        (2)  In these Regulations-
      "the Act" means the Local Government Act 1988, and

      "the principal Regulations" means the Local Government Act 1988 (Defined Activities) (Competition) (England) Regulations 1988[2].

    Postponement of date
        2.—(1)  Regulation 4(2) of the principal Regulations shall, in its application to the Tunbridge Wells Borough Council, have effect as if-
       (a) for the first reference to 1993 there were substituted a reference to 1992, and
       (b) the last line of the table were omitted.

        (2)  In relation to functional work of any description falling within the defined activity mentioned in section 2(2)(f) of the Act (maintenance of ground) which is proposed to be carried out by the Tunbridge Wells Borough Council in the calendar year 1993, section 6 of the Act shall apply-
       (a) in the period beginning on 1st January and ending on 30th June 1993, to such part of the work as is estimated by the authority to equal in value 60 per cent. of the value of earlier work (within the meaning of regulation 4(3) of the principal Regulations), and
       (b) in the remaining period of the year, to such part of the work as is so estimated to equal in value 80 per cent. of the value of such earlier work.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if certain conditions are fulfilled. The Local Government Act 1988 (Defined Activities) (Competition) (England) Regulations 1988 apply those conditions to work consisting of the maintenance of ground, in successive stages.
    Under these regulations the Tunbridge Wells Borough Council may not carry out more than 80 per cent. of such work proposed to be undertaken by them without complying before 1st January 1993 with those conditions. These Regulations postpone the date for such compliance to 1st July 1993.
