The Street Works (Notices) Order 1992

Made 3rd December 1992
Laid before Parliament 10th December 1992
Coming into force 1st January 1993

    The Secretary of State for Transport and the Secretary of State for Wales in exercise of their powers under section 102 of the New Roads and Street Works Act 1991[1]and all other enabling powers, hereby make the following Order:—
        1.—(1)   This Order may be cited as the Street Works (Notices) Order 1992 and shall come into force on 1st January 1993.

        (2)  In this Order:—
      "enactment" means any enactment passed or made before the commencement of section 102 of the New Roads and Street Works Act 1991 (not being a special enactment to which section 101(1), (2) or (3) of that Act applies).

        2.    Any notice given in compliance with any of the provisions of the Street Works (Registers, Notices, Directions and Designations) Regulations 1992[2]shall be deemed to satisfy any requirement made by or under any enactment or any instrument having effect under or by virtue of any enactment to give notice of any matter covered by the Regulations to the person to whom that notice is required to be given by or under such enactment or instrument.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order provides that a notice given under the Street Works (Registers, Notices, Directions and Designations) Regulations 1992 shall satisfy the requirements of any other enactment (other than a special enactment to which section 101(1), (2) or (3) of the New Roads and Street Works Act 1991 applies) with regard to the giving of notice of proposed street works.
