CHANGES IN LOCAL GOVERNMENT AREAS

The Cambridgeshire and Suffolk (County Boundaries) Order 1992

Made 1st December 1992
Laid before Parliament 11th December 1992
Coming into force
  for the purposes referred to in article 1(2) 1st December 1993
  for all other purposes 1st April 1994

    The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972[1] and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect, with modifications, to proposals submitted to him under sections 47,48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:
    Citation and commencement
        1.—(1)  This Order may be cited as the Cambridgeshire and Suffolk (County Boundaries) Order 1992.

        (2)  This Order shall come into force on 1st December 1993 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976[2].

        (3)  For all other purposes, this Order shall come into force on 1st April 1994.
    Interpretation
        2.    In this Order—
      "Cambridgeshire" means the county of Cambridgeshire, and "East Cambridgeshire" means the district of East Cambridgeshire in that county;

      "electoral division" means an electoral division of the county to which an area is transferred by this Order[3];

      "the map" means one of the 7 maps prepared by the Department of the Environment, marked "Maps of the Cambridgeshire and Suffolk (County Boundaries) Order 1992", and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

      "Suffolk" means the county of Suffolk, and "Forest Heath" means the district of Forest Heath in that county;

      any reference to an "unparished" area is a reference to an area not forming part of any parish; and

      "ward" means a ward of the district to which an area is transferred[4].

    Transfers from Cambridgeshire to Suffolk
        3.    Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Cambridgeshire, from East Cambridgeshire and from the parish named in column 3 to—
       (a) Suffolk;
       (b) Forest Heath;
       (c) the parish (if any) mentioned in column 4;
       (d) the ward and the electoral division so mentioned;
       (e) the Newmarket petty sessional division and the West Suffolk coroner's district.

    Transfers from Suffolk to Cambridgeshire
        4.    Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Suffolk, from Forest Heath, and from the parish (or, where unparished, the ward) named in column 3 to—
       (a) Cambridgeshire;
       (b) East Cambridgeshire;
       (c) the parish mentioned in column 4;
       (d) the ward and the electoral division so mentioned;
       (e) the East Cambridgeshire petty sessional division and the Cambridge City and Southern coroner's district.

    Town and country planning
        5.—(1)  In this article, "provision" means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990[5]).

        (2)  Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order realigns the boundary between the counties of Cambridgeshire and Suffolk, affecting the Cambridgeshire district of East Cambridgeshire and the Suffolk district of Forest Heath. Most of the areas transferred are small. In approximate terms, the areas transferred from Cambridgeshire to Suffolk have a total area of 375 hectares, and a population of 10, while those transferred from Suffolk to Cambridgeshire have an area of 7 hectares, and a population of 2. Consequential changes to the boundaries of local government electoral areas, petty sessional divisions and coroners' districts are made.
    This map and table forming part of this Note are a general guide only to the areas affected, and the maps described in article 2 should be inspected for full details of the transfers. Any person may inspect the maps at all reasonable times at the offices of the council for each district affected, and additionally at the offices of the Secretary of State for the Environment located in 2 Marsham Street, London SW1P 3EB.

    The Local Government Area Changes Regulations 1976 contain general provisions regarding the effect of orders such as this one.

      Realignment in vicinity of B1506 road at Snailwell Belt.

      Parish of Moulton/Parish of Ashley
      Realignments south of Moulton Road/Warren Hill House.
          6.    
      Unparished area of Newmarket/Parish of Woodditton
      Realignment in vicinity of Newmarket Railway Station/Crockford's Road.
          7.    
      Unparished area of Newmarket/Parish of Cheveley
      Realignments at Ashley Road/Centre Drive/Duchess Drive in vicinity of B1103 road.
