The Wildlife and Countryside Act 1981 (Variation of Schedules 2 and 3) Order 1992

Made 2nd December 1992
Laid before Parliament 10th December 1992
Coming into force 1st January 1993

    The Secretary of State-
    having given any local authority affected and any other person affected an opportunity to submit objections or representations with respect to the subject matter of this Order;
    having consulted the Joint Nature Conservation Committee, being the advisory body he considered was best able to advise him as to whether the order should be made;
    in exercise of the powers conferred on him by section 22(1) of the Wildlife and Countryside Act 1981[1], and of all other powers enabling him in that behalf, hereby makes the following Order:
    Citation and commencement
        1.    This Order may be cited as the Wildlife and Countryside Act 1981 (Variation of Schedules 2 and 3) Order 1992 and shall come into force on 1st January 1993.
    Variation of Schedule 2
        2.    The following birds are removed from Part II of Schedule 2 to the Wildlife and Countryside Act 1981-

    Crow Corvus corone
    Dove, Collared Streptopelia decaocto
    Gull, Great Black-backed Larus marinus
    Gull, Lesser Black-backed Larus fuscus
    Gull, Herring Larus argentatus
    Jackdaw Corvus monedula
    Jay Garrulus glandarius
    Magpie Pica pica
    Pigeon, Feral Columba livia
    Rook Corvus frugilegus
    Sparrow, House Passer domesticus
    Starling Sturnus vulgaris

        3.    The following bird is removed from Part II of Schedule 3 to the Wildlife and Countryside Act 1981 -

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order, which applies throughout Great Britain, gives effect in part to Council Directive 79/409/EEC (OJ No. L103, 25.4.1979, p.1). Article 2 of the Order removes 13 species from Part II of Schedule 2 to the Act, which lists species of birds which may be killed or taken by authorised persons at all times. Article 3 of the Order removes 1 species from Part II of Schedule 3 to the Act, which lists species of bird which may be sold dead at all times.
