ROADS AND BRIDGES, SCOTLAND

The New Roads and Street Works Act 1991 (Commencement No.6 and Transitional Provisions and Savings) (Scotland) Order 1992

Made 28th November 1992

    The Secretary of State, in exercise of the powers conferred on him by section 170 of the New Roads and Street Works Act 1991[1], and of all other powers enabling him in that behalf, hereby makes the following Order:


PART I

GENERAL
    Citation and interpretation
        1.—(1)  This Order may be cited as the New Roads and Street Works Act 1991 (Commencement No.6 and Transitional Provisions and Savings) (Scotland) Order 1992.

        (2)  In this Order—
      "the 1950 Act" means the Public Utilities Street Works Act 1950[2];

      "the 1984 Act" means the Roads (Scotland) Act 1984[3];

      "the 1991 Act" means the New Roads and Street Works Act 1991;

      "sewer authority" has the same meaning as in section 39(1)[4] of the 1950 Act;

      "special road" has the same meaning as in section 151(1) of the 1984 Act;

      "special road authority" has the same meaning as in section 7(4) of the 1984 Act;

      "statutory undertaker" means an undertaker who is entitled to carry out road works by virtue of a statutory right.

    Commencement of certain provisions of the 1991 Act
        2.—(1)  The provisions of the 1991 Act specified in the first column of Schedule 1 to this Order (which relates to the matters specified in the second column thereof) shall come into force on 30th November 1992.

        (2)  The provisions of the 1991 Act specified in the first column of Schedule 2 to this Order (which relates to the matters specified in the second column thereof) shall come into force on 1st January 1993.

        (3)  The provisions of the 1991 Act specified in the first column of Schedule 3 to this Order (which relates to the matters specified in the second column thereof) shall come into force on 1st April 1993.
