HIGHWAYS, ENGLAND AND WALES

The M65 Motorway (Bamber Bridge to Whitebirk Section, Blackburn Southern Bypass) and Connecting Roads Scheme 1991 Variation Scheme 1992

Made 21st October 1992
Coming into force 12th November 1992

    The Secretary of State for Transport makes this Scheme in exercise of powers conferred by sections 16, 17, 19 and 326 of the Highways Act 1980[1], and now vested in him[2], and of all other enabling powers:—
        1.    The M65 Motorway (Bamber Bridge to Whitebirk Section, Blackburn Southern Bypass) and Connecting Roads Scheme 1991[3] (hereinafter referred to as "the principal scheme") is varied as hereinafter mentioned.
        2.    The Schedule to this Scheme, which is numbered 2A, is added to the principal scheme, and accordingly—
       (a) in article 1(b) of the principal scheme, the words and number "and Schedule 2A" are inserted after the word and number "Schedule 2";
       (b) for article 5(2)(i) of the principal scheme is substituted the following sub-paragraph—
          "(i) "the deposited plan" means the plan folio numbered HA16/1 CNW 290 marked "The M65 Motorway (Bamber Bridge to Whitebirk Section, Blackburn Southern Bypass) and Connecting Roads Scheme 1991"(containing 1 key plan and 3 scheme plans bound together and numbered 1, 2 and 3), and the plan folio numbered HA16/1 CNW 322 marked "The M65 Motorway (Bamber Bridge to Whitebirk Section, Blackburn Southern Bypass) and Connecting Roads Scheme 1991 Variation Scheme 1992" containing 1 key plan and 1 scheme plan numbered 2A), each signed by authority of the Secretary of State and deposited at the Department of Transport, 43 Marsham Street, London SW1P 3PY;" ;
       (c) for paragraph 7 of Schedule 2 to the principal scheme is substituted the following paragraph—
              "7.    Junction with Blackburn Road (A678) and Whitebirk Drive (A6119) at Whitebirk.


          A route from the Whitebirk Roundabout (Junction 6 on the M65, giving access to Blackburn Road (A678) and Whitebirk Drive (A6119)), to the eastbound carriageway of the M65. The special road along this route being given the reference number 34 on Scheme Plan No. 3 in the deposited plan." ; and
       (d) the heavy black line on Scheme Plan No. 3 in the deposited plan, within the meaning of the principal scheme, which is given reference number 35, shall be disregarded.
        3.    This Scheme shall come into force on 12th November 1992 and may be cited as the M65 Motorway (Bamber Bridge to Whitebirk Section, Blackburn Southern Bypass) and Connecting Roads Scheme 1991 Variation Scheme 1992.
