EDUCATION, ENGLAND AND WALES

The Further and Higher Education Act 1992 (Commencement No.2) Order 1992

Made 1st September 1992

    In exercise of the powers conferred by section 89(4) and section 94(3) of the Further and Higher Education Act 1992[1], the Secretary of State for Wales hereby makes the following Order:
        1.    This Order may be cited as the Further and Higher Education Act 1992 (Commencement No. 2) Order 1992.
        2.    The provisions of section 9(4) of the Further and Higher Education Act 1992 ("the Act") shall come into force on 1st April 1993.
        3.    Paragraph 10 of Schedule 8 to the Act shall come into force on 1st September 1992 so far as it relates to institutions within the PCFC funding sector in Wales and otherwise in Wales on 1st April 1993.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into force section 9(4) of the Further and Higher Education Act 1992 on 1st April 1993. Paragraph 10 of Schedule 8 to the Act is brought into force on 1st September 1992 so far as it relates to institutions within the Polytechnics and Colleges Funding Council (PCFC) funding sector in Wales, and otherwise in Wales on 1st April 1993.
    Section 9(4) provides that Her Majesty's Chief Inspector of Schools in Wales shall, if asked to do so by the Further Education Funding Council for Wales, assess the quality of education provided in institutions specified in section 9(4).
    Paragraph 10 of Schedule 8 (Minor and Consequential Amendments), already in force in England, by virtue of S.I. 1992/831, provides that Section 77 of the Education Act 1944[2] (inspection of educational establishments) shall cease to have effect in relation to any institution other than a school.
