CHANGES IN LOCAL GOVERNMENT AREAS

The Greater Manchester and West Yorkshire (County and District Boundaries) Order 1992

  for the purposes referred to in article 1(2) 2nd October 1992
  for all other purposes 1st April 1993


    The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972[1] and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:
    Citation and commencement
        1.—(1)  This Order may be cited as the Greater Manchester and West Yorkshire (County and District Boundaries) Order 1992.

        (2)  This Order shall come into force on 2nd October 1992 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976[2].

        (3)  For all other purposes, this Order shall come into force on 1st April 1993.
    Interpretation
        2.    In this Order—
      "district" includes a metropolitan borough and a city;

      any reference to Manchester is a reference to the district of that name, except in the expression "Greater Manchester", where it means the metropolitan county of Greater Manchester;

      "the map" means one of the 16 maps prepared by the Department of the Environment, marked "Maps of the Greater Manchester and West Yorkshire (County and District Boundaries) Order 1992", duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

      any reference to Oldham, to Rochdale or to Tameside is a reference to the district of that name in Greater Manchester;

      any reference to an area as unparished is a reference to an area not forming part of any parish;

      any reference to a ward is a reference to a ward of the district from or to which an area is transferred; and

      "West Yorkshire" means the metropolitan county of West Yorkshire, any reference to Kirklees being a reference to the district of that name in that county.

    Transfers from Greater Manchester (Oldham) to West Yorkshire (Kirklees)
        3.    The parts of the parish of Saddleworth marked A on map 7 and B on map 6 shall be transferred from Greater Manchester, from Oldham and from that parish to—

      (a)  West Yorkshire;

      (b)  Kirklees, and the Colne Valley West ward; and to

      (c)  the Huddersfield petty sessional division and the West Yorkshire Western coroner's district;
    they shall become unparished.
    Transfers within Greater Manchester between Oldham and Rochdale
        4.—(1)  Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Oldham and from the parish (or, if unparished, from the ward) named in column 3 to Rochdale, and to the ward and petty sessional division mentioned in column 4, becoming or remaining unparished.

        5.—(1)  The following unparished areas of Manchester shown on map 9—

      (i)  the parts of Moston ward marked A, B, D, F, G and J; and

      (ii)  the parts of Newton Heath ward marked L, N, Q, S, U and W—
    shall be transferred to Oldham, to the Failsworth West ward, to the Oldham petty sessional division and to the Greater Manchester North coroner's district, remaining unparished.
        (2)  Each area which is marked on the map as indicated in column 1 of the following Table shall be transferred from Oldham, and from the ward named in column 2 to Manchester, to the ward mentioned in column 3, and to the Manchester petty sessional division and the Manchester coroner's district, remaining unparished.

    Town and country planning
        7.—(1)  In this article, "provision" means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990[3]).

        (2)  Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

EXPLANATORY NOTE

(This note is not part of the Order)

    This Order makes minor alterations to the boundary between the metropolitan counties of Greater Manchester and West Yorkshire by transferring two small areas from Oldham in the former county to Kirklees in the latter.
    This Order also transfers areas between metropolitan boroughs within Greater Manchester. Oldham, Rochdale, the city of Manchester, and Tameside are affected. The map and table at the end of this Note give a general guide to the areas affected and the changes made. The table also gives a approximate figure for the total area of land involved (in hectares), and for the population affected.
    For full details of the transfers made, the order maps (described in article 2) should be inspected. Any person may inspect them at any reasonable time at the offices of the council for each metropolitan borough or city affected, and also at the offices of the Secretary of State for the Environment located in 2, Marsham Street, London SW1P 3EB.
    Consequential changes are made to local government electoral areas, petty sessional divisions and coroners' districts. The Local Government Area Changes Regulations 1976 (S.I. 1976/246, amended by S.I. 1978/247) contain general provisions regarding the effect of orders such as this one.

      Transfer to the east of Milnrow Road, including Jubilee House, Oakfield and part of the Jubilee Fulling Mill.
      Realignment in the Bentgate area to follow centre of the River Beal.

      Manchester to Oldham
      Area: 1h.
      Population: 7
    Transfer of area in vicinity of Hobson Street, including Linwood Street, Heath Cottage, and part of the Meadow Mills industrial site.

      Oldham to Manchester
      Area: 6.5 h.
      Population: 5

      Transfer of part of Presentation Convent and of the St. Margaret Mary's School site.
      Transfer of part of Brookdale Park, including the recreation ground lying between Bradshaw Avenue and Hulmes Road.

      Oldham to Tameside
      Area: 7 h.
      Population: 2
    Transfer of area north of Holly Bank Farm, including Butt Farm and part of Under Lane and Grotton Brick Works.

      Tameside to Oldham
      Area: 3.5 h.
      Population: 10

      Realignments of boundary in Medlock Vale area to follow centre of River Medlock.
      Transfer at Quick of area including Quick House, Manor House and part of Strawberry Lane.
