The Dartford-Thurrock Crossing (Amendment) Regulations 1992

Made 5th August 1992
Laid before Parliament 6th August 1992
Coming into force 1st September 1992

    The Secretary of State for Transport, in exercise of the powers conferred on him by sections 25(1) and (2), 26(1) and (3)(d), 44(3) and 46(1)[1] of the Dartford-Thurrock Crossing Act 1988[2], and of all other enabling powers, hereby makes the following Regulations:
        1.    These Regulations may be cited as the Dartford-Thurrock Crossing (Amendment) Regulations 1992 and shall come into force on 1st September 1992.
        2.    The Dartford-Thurrock Crossing Regulations 1989[3] shall be amended in accordance with the following provisions of these Regulations.
        3.    In regulation 5(1)—
       (a) after the words "The driver of a vehicle" there shall be inserted "which is of a description set out in the first column of the table below";
       (b) in sub-paragraph (a) for the words "a charge as set out in Part I of the table below" there shall be substituted "such charge as is set out in respect thereof in Part I of that table";
       (c) in sub-paragraph (b) for the words "a charge as set out in Part II of the table below" there shall be substituted "such charge as is set out in respect thereof in Part II of that table";
       (d) in the table there set out in the third column headed "Charge"—
         (i) for "£33" wherever it occurs there shall be substituted "£34"; and
         (ii) for "£150" wherever it occurs there shall be substituted "£157".
        4.    In regulation 12(1) in the table there set out—
       (a) in column (1) headed "Minimum Charge"—
         (i) for "£46" there shall be substituted "£48";
         (ii) for "£27" there shall be substituted "£28"; and
         (iii) for "£92" there shall be substituted "£96";
       (b) in column (2) headed "Additional Charge" for "£30" there shall be substituted "£31".

EXPLANATORY NOTE

(This Note is not part of the Regulations)
    These Regulations amend the Dartford-Thurrock Crossing Regulations 1989 ( "the 1989 Regulations") in the following ways.
    First, by amending regulation 5 of the 1989 Regulations to make it clear that, under that regulation, charges are made, not in the case of any vehicle, but only in the case of a vehicle falling within the relevant Part of the Table set out in that regulation: see regulation 3(a)-(c) of these Regulations.
    Secondly, by increasing some (not all) of the charges to be made under regulation 5 in respect of vehicles above a specified width or length or weight which use the crossing: see regulation 3(d) of these Regulations. (These charges are in addition to any tolls which may be levied.)
    Thirdly, by increasing some (not all) of the minimum and additional charges which are used to calculate the fee payable under regulation 12 of the 1989 Regulations in respect of the attendance at or the removal of a vehicle which has broken down on the crossing: see regulation 4 of these Regulations.
