CHANGES IN LOCAL GOVERNMENT AREAS

The Stafford and Staffordshire Moorlands (District Boundaries) Order 1992

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972^[1] and of all other powers enabling him in that behalf, makes the following Order, which gives effect to proposals submitted to him under sections 47 and 51(1) of that Act, more than six weeks before the making of this Order by the Local Government Boundary Commission for England:

Citation and commencement
    1.—(1)  This Order may be cited as the Stafford and Staffordshire Moorlands (District Boundaries) Order 1992.

    (2)  This Order shall come into force on 25th August 1992 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976^[2].

    (3)  For all other purposes, this Order shall come into force on 1st April 1993.

Interpretation
    2.    In this Order—

any reference to an electoral division is a reference to an electoral division of the county of Staffordshire;

"the map " means the map prepared by the Department of the Environment, marked "Map of the Stafford and Staffordshire Moorlands (District Boundaries) Order 1992 ", and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

"Stafford " means the borough of Stafford; and

"Staffordshire Moorlands " means the district of that name.

Transfers between Stafford (Fulford) and Staffordshire Moorlands (Forsbrook)
    3.—(1)  The area marked B on the map shall be transferred from Stafford, and from the parish of Fulford to—
 (a) Staffordshire Moorlands;
 (b) the parish of Forsbrook;
 (c) the Forsbrook district ward, and the Caverswall electoral division; and to
 (d) the Staffordshire Moorlands petty sessional division.

    (2)  The areas marked A and C on the map shall be transferred from Staffordshire Moorlands, and from the parish of Forsbrook to—
 (a) Stafford;
 (b) the parish of Fulford, and the Blythe Bridge parish ward:
 (c) the Fulford borough ward, and the Stone Rural electoral division; and to
 (d) the Mid Staffordshire petty sessional division.

Town and country planning
    4.—(1)  In this article, "provision" means a provision of a development plan (as defined in section 336 of the Town and Country Planning Act 1990^[3]).

    (2)  Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

This Order makes minor changes in the boundary between the borough of Stafford (parish of Fulford) and the district of Staffordshire Moorlands (parish of Forsbrook). The effect of the Order is to realign that boundary so that it follows the northern side of Uttoxeter Road in an area starting to the north-west of the White Cock public house and running south-eastwards to a point just beyond the Road's junction with Grindley Lane in the vicinity of The Farm. Consequential changes are made to the boundaries of the parishes, local government electoral areas, and petty sessional divisions.

This Note and the map forming part of it give a general guide only to the changes effected, and for full details of the three small transfers made, the order map mentioned in article 2 should be inspected.

Any person may inspect the map at any reasonable time at the offices of the Stafford Borough Council and of the Staffordshire Moorlands District Council, and also at the offices of the Secretary of State for the Environment located in 2, Marsham Street, London SW1P 3EB.

In approximate terms, the area transferred from Stafford to Staffordshire Moorlands has an area of 0.7 hectares and a population of 35. The areas transferred from Staffordshire Moorlands to Stafford have a total area of 0.9 hectares, and are unpopulated.

The Local Government Area Changes Regulations 1976 contain general provisions regarding the effect of orders such as the present one.
