PENSIONS

The Pensions for Dependants of the Prime Minister or Speaker (Designated Provisions) Regulations 1992

The Leader of the House of Commons, in exercise of the powers conferred on him by section 27(2) and (2A) of the Parliamentary and other Pensions Act 1972^[1] hereby makes the following Regulations:

Citation and commencement
    1.    These Regulations may be cited as the Pensions for Dependants of the Prime Minister or Speaker (Designated Provisions) Regulations 1992.

Designated provisions
    2.    Sections 13. 13A and 15 of the Parliamentary and other Pensions Act 1972^[2] are designated for the purposes of section 27 of that Act.

These Regulations make provision with respect to the payment of pensions to widows or widowers or for the benefit of children of deceased Prime Ministers of Speakers of the House of Commons.

Section 27 of the Parliamentary and other Pensions Act 1972 (c. 48) provides the basis for the payment from the Consolidated Fund of pensions to widows and widowers or for the benefit of children of deceased Prime Ministers or Speakers; the section provides for designated provisions of the Parliamentary pension scheme to have effect as if the Prime Minister or Speaker concerned had at the time of his death been entitled in respect of service as a Member of the House of Commons to receive a pension under the Parliamentary pension scheme.

These Regulations designate for the purposes of section 27 those provisions of the Parliamentary pension scheme contained in sections 13, 13A and 15 of that Act which are to apply in relation to the widows, widowers or children of deceased Prime Ministers and Speakers.

Part I of this Act (sections 1-25) was repealed, with savings, by the Parliamentary and other Pensions Act 1987 (c. 45): the enactments in that Part (other than sections 1(1) to (4) and (7), 5, 23 and 24(4)), have effect as if they were contained in regulations made in accordance with section 2 of the 1987 Act, and they may be amended as such. Section 13(1)(b) was amended by section 22(4) of, and paragraphs 4 and 10 of Schedule 1 to, the Parliamentary Pensions Act 1978 (c. 56); section 13(1)(b) was partially repealed by sections 3(1)(b), 5(5) and (7) of, and the Schedule to, the Parliamentary Pensions etc. Act 1984 (c. 52); section 13(2) was amended by regulation 10 of the Parliamentary Pensions (Amendement) Regulations 1991 S.I. No. 609; section 13(4) was amended by section 7 of the Parliamentary Pensions etc. Act 1984 (c. 52); section 13A was inserted by section 8(1) of the Parliamentary Pensions etc. Act 1984 (c. 52); section 15(2)-(4) was partially repealed, and sub-sections (2) and (6)(a) amended, by sections 9 and 22(5) of, and Schedule to, the Parliamentary Pensions Act 1978 (c. 56); section 15(2) was further amended by regulation 11 of the Parliamentary Pensions (Amendment) Regulations 1991 S.I. No. 609; section 15(4) and (6) was amended by section 108(1)(a) of, and paragrah 77 of Schedule 3, to the Children Act 1975 (c. 72) and section 8(3)(a) and (b) of the Parliamentary Pensions etc. Act 1984 (c. 52). back
