The Fodder Plant Seeds (Amendment) Regulations 1992

Coming into force 5th August 1992

    The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by sections 16(1), (3)(c) and (8) and 36 of the Plant Varieties and Seeds Act 1964[1] and of all other powers enabling them in that behalf[2], after consultation in accordance with the said section 16(1) with representatives of such interests as appear to them to be concerned, hereby make the following Regulations:
    Title and commencement
        1.    These Regulations may be cited as the Fodder Plant Seeds (Amendment) Regulations 1992 and shall come into force on 5th August 1992.
    Amendment of the Fodder Plant Seeds Regulations 1985
        2.    The Fodder Plant Seeds Regulations 1985[3] shall be amended in accordance with the following provisions of these Regulations.
    Addition of Festulolium
        3.—(1)  In Schedule 1 (‘(A)Gramineae’) below the words "Festuca rubra L." there shall be inserted the words "Festuca pratensis Huds. x Lolium multiflorum Lam." and below the words "Red fescue, Chewings fescue" there shall be inserted the word "Festulolium".

        (2)  In Schedule 4 Part II paragraph 5 below the words "Red fescue" there shall be inserted the word "Festulolium" and at the appropriate place in columns (2), (4), (6) and (7) there shall be inserted respectively the figures "75", "96", "0.3" and "1.5".

        (3)  In Schedule 4 Part II paragraph 6 below the words "Red fescue" there shall be inserted the word "Festulolium" and at the appropriate place in columns (2), (3), (4), (5), (6), (8), (9), (11), (12), (16) and (17) there shall be inserted respectively the figures "60", "0", "0a", "2", "5", "5", "0.3", "5", "0.5", "20b" and "1.0".

        (4)  In Schedule 5 Part I paragraph 11(i) in the Table for the dimensions of the dynamic spear sampler after the word "ryegrasses" there shall be inserted the word "festulolium".

        (5)  In Schedule 5 Part II in the table in paragraph b below the word "Fescues" there shall be inserted the word "Festulolium" and at the appropriate place in the columns headed "Breeder's, Pre-basic and Basic Seed" and "All other Categories" there shall be inserted the figure "200".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations, which further amend the Fodder Plant Seeds Regulations 1985, implement Council Directive 66/401/EEC (OJ No. L125, 11.7.66, p.2298/66) as amended by Commission Directive 92/19/EEC (OJ No. L104, 22.4.92, p.61) by adding Festulolium (a cross between Meadow fescue and Italian Ryegrass) to the Regulations.
