COAST PROTECTION

The Coast Protection (Variation of Excluded Waters) (Chichester, Langstone and Portsmouth Harbours) Regulations 1992

Laid before Parliament 14th July 1992
Coming into force 4th August 1992

    The Minister of Agriculture, Fisheries and Food in exercise of the powers conferred by paragraph 113 of Schedule 4 to the Coast Protection Act 1949[1] and now vested in him[2] and of all other powers enabling him in that behalf, hereby makes the following Regulations:
        1.    These Regulations may be cited as the Coast Protection (Variation of Excluded Waters) (Chichester, Langstone and Portsmouth Harbours) Regulations 1992 and shall come into force on 4th August 1992.
        2.    For Paragraphs 30, 31 and 32 of Schedule 4 to the Coast Protection Act 1949 (which exclude parts of Chichester, Langstone and Portsmouth Harbours for the purposes of the definition of "sea" and "seashore" in that Act) there shall be substituted the following, namely—
            "30.    Chichester Harbour, above the Chichester to Southampton railway line.

            31.    Langstone Harbour, above the Chichester to Southampton railway line.

            32.    Portsmouth Harbour, above the Chichester to Southampton railway line." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    Schedule 4 to the Coast Protection Act 1949 excludes certain waters for the purposes of the definitions of the expressions "sea" and "seashore" in section 49(1) of the Act but provides that the Schedule may be varied by regulations.
    These Regulations amend Schedule 4 so as to extend the area of Chichester, Langstone and Portsmouth Harbours which is covered by the above expressions.
