The Special Roads (Notice of Opening) Regulations 1992

Made 9th June 1992
Laid before Parliament 10th June 1992
Coming into force 1st August 1992

    The Secretary of State for Transport as respects England and the Secretary of State for Wales as respects Wales, in exercise of the powers conferred by sections 17(5) and 142(1) of the Road Traffic Regulation Act 1984[1], and all other enabling powers, and after consulting representative organisations in accordance with section 134(2) of that Act, hereby make the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Special Roads (Notice of Opening) Regulations 1992 and shall come into force on 1st August 1992.
    Revocation
        2.    The Special Roads (Notice of Opening) Regulations 1962[2] are hereby revoked.
    Notice of opening of a special road
        3.    The notice required for the purposes of section 17(5) of the Road Traffic Regulation Act 1984 to be published by the traffic authority for a special road, declaring the date on which that road or part of it is open for use as a special road, shall, not less than 7 days before that date, be published in at least one local newspaper circulating in the area in which the special road or, as the case may be, the relevant part of it is situated and in the London Gazette.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations prescribe the means of publicising the notice of the date on which a new special road, or part of such a road, is first open for use as a special road, and revoke the previous provisions.
