ROAD TRAFFIC

The Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) (Amendment) (No. 2) Regulations 1992

Laid before Parliament 8th June 1992
Coming into force 1st July 1992

    The Secretary of State for Transport, in exercise of the powers conferred by sections 54(1) and 61 of the Road Traffic Act 1988[1], and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:
    Citation and commencement
        1.    These Regulations may be cited as the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) (Amendment) (No. 2) Regulations 1992 and shall come into force on 1st July 1992.
    Preliminary
        2.    The Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982[2] are further amended in accordance with the following provisions.
    Amendments as to exhaust emissions
        3.—(1)  In regulation 4—
       (a) in paragraph (3), for "If a vehicle or vehicle part" there is substituted "Save as provided in paragraph (3A) of this regulation, if a vehicle or vehicle part";
       (b) after paragraph (3), there is inserted the following new paragraph—
        "  (3A)  The provisions of paragraph (3) of this regulation do not apply in respect of items 2B, 2C, 2D and 2E in Schedule 1" ;
       (c) in paragraph (14), for "item 2B and column (5) of items 2C and 2D" there is substituted "items 2B, 2C and 2D, and column (6) of items 2E, 7 and 8".

        (2)  In Schedule 1—
       (a) in item 2B, in column (3)(a), in the third of the alternative sets of particulars of instruments or other documents, for "and amended on 1st June 1984" there is substituted "and amended on 1st June 1984 and corrected on 16th May 1989";
       (b) for item 2C, there is substituted item 2C as specified in Schedule 1 to these Regulations;
       (c) for item 2D, there is substituted item 2D as specified in Schedule 1 to these Regulations;
       (d) after item 2D, there is inserted new items 2E, 2F, 2G and 2H as specified in Schedule 1 to these Regulations;
       (e) in item 7, in column (6), there is inserted "See regulation 4(14) and Schedule 1B"; and
       (f) in item 8, in column (6), there is inserted "See regulation 4(14) and Schedule 1B".

        (3)  In Part 1 of Schedule 1B—
       (a) in paragraph 1, for the words "Items 2B, 2C and 2D" there is substituted "Items 2B, 2C, 2D, 2E, 7 and 8";
       (b) in paragraph 3(1)(a), for the words "sub-paragraph (2)" there is substituted "sub-paragraphs (2) or (3)"; and
       (c) after paragraph 3(2) there are inserted the following sub-paragraphs—
        "  (3)  This sub-paragraph applies in relation to item 2D where a vehicle is fitted with an engine which is described in the Annex to the type-approval certificate granted before the 1st July 1992 in accordance with Council Directive 88/77/EEC[3].

            (4)  Expressions used in paragraph (3), which are also used in article 3 of Council Directive 91/542/EEC[4], have the same meaning as in that article."

        (4)  For Part II of Schedule 1B there is substituted the new Part II as specified in Schedule 2 to these Regulations.
    Amendments as to speed limiters
        4.    In Schedule 1, in column (4) of item 9, for the words "of less than" there is substituted "not exceeding" and in column (5), opposite the second entry in column (3) there is inserted "1.2.1992".
