TOWN AND COUNTRY PLANNING, ENGLAND AND WALES

The Planning and Compensation Act 1991 (Commencement No. 9 and Transitional Provision) Order 1992

Made 1st June 1992

    The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by section 84(2) and (3) of the Planning and Compensation Act 1991[1] and all other powers enabling them in that behalf, hereby make the following Order:
    Citation and interpretation
        1.—(1)  This Order may be cited as the Planning and Compensation Act 1991 (Commencement No. 9 and Transitional Provision) Order 1992.

        (2)  In this Order, "the 1991 Act" means the Planning and Compensation Act 1991.
    Commencement of provisions concerning demolition of buildings
        2.    The following provisions of the 1991 Act shall come into force on 27th July 1992—
      section 13, so far as it is not yet in force; and

      section 32, so far as it relates to paragraphs 10(2) and 52(2)(c) of Schedule 7.

    Transitional provision
        3.    Section 13 of, and paragraph 52(2)(c) of Schedule 7 to, the 1991 Act shall not have effect so far as they relate to the demolition of a building on land in a case where, before 27th July 1992, planning permission has been granted under Part III of the Town and Country Planning Act 1990[2] (except under article 3 of, and Schedule 2 to, the Town and Country Planning General Development Order 1988[3]), or has been deemed to be granted under that Part of that Act, for the redevelopment of the land.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order brings into force, on 27th July 1992, section 13 of the Planning and Compensation Act 1991 (demolition of buildings) and section 32 of that Act (planning: minor and consequential amendments) so far as that section relates to paragraphs 10(2) and 52(2)(c) of Schedule 7 to the 1991 Act.
