The Milk (Special Designation) Regulations (Amendment) Order 1992

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Health and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 4(1) and 59(2) of the Food Safety Act 1990^[1], and of all other powers enabling them in that behalf, hereby make the following Order:—

Title, commencement and interpretation
    1.—(1)  This Order may be cited as the Milk (Special Designation) Regulations (Amendment) Order 1992 and shall come into force on 23rd June 1992.

    (2)  This Order shall apply to England and Wales.

Amendment of the Milk (Special Designation) Regulations 1989
    2.    The Milk (Special Designation) Regulations 1989^[2] shall have effect subject to the following amendments—
 (a) after regulation 2A(5) there shall be inserted the following paragraph—
"(6) any person contravenes or fails to comply with any of the provisions of this Regulation he shall be guilty of an offence." ;

 (b) after regulation 2B(3) there shall be inserted the following paragraph—
"(4) If any person contravenes or fails to comply with any of the provisions of this Regulation he shall be guilty of an offence." .

This Order which applies only to England and Wales further amends the Milk (Special Designation) Regulations 1989 as previously amended by the Food Safety Act 1990 (Consequential Modifications) (England and Wales) Order 1990. By virtue of article 13 of that Order, restrictions on the sale of milk without correct use of a special designation and on use of a special designation without a licence authorising such use, previously in the Food Act 1984, were inserted in the 1989 Regulations but the provision for offence of breach of those restrictions was omitted. This Order inserts the offence provision.
