EDUCATION, ENGLAND AND WALES

The Education (Grant-maintained Schools) (Finance) (Amendment) Regulations 1992

Coming into force 28th May 1992

    In exercise of the powers conferred on the Secretary of State by sections 79 and 232(5) of the Education Reform Act 1988[1] the Secretary of State for Education and Science hereby makes the following Regulations:
        1.—(1)  These Regulations may be cited as the Education (Grant-maintained Schools) (Finance) (Amendment) Regulations 1992 and shall come into force on 28th May 1992.

        (2)  Any reference in these Regulations to a numbered regulation is a reference to the regulation so numbered in the Education (Grant-maintained Schools) (Finance) Regulations 1992[2].
        2.    In the table in regulation 2(2) for the words "regulation 15(5)" there shall be substituted the words "regulation 15(4)".
        3.    In regulation 5(5) for the words "paragraph (2)" there shall be substituted the words "paragraph (1)".
        4.    In Regulation 9—
       (a) in paragraph (1), the words "Without prejudice to regulation 10" shall be omitted; and
       (b) in paragraphs (1)(c) and (2), after the words "regulation 8" there shall be inserted the words "or, as the case may be, regulation 10(4)".
        5.    In regulation 10(1)—
       (a) at the beginning there shall be inserted the words "Subject to regulation 9,"; and
       (b) the words "or 9" shall be omitted.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations which come into force on 28th May 1992 amend the Education (Grant-maintained Schools) (Finance) Regulations 1992 ( "the 1992 Regulations").
    The Regulations substitute for the reference in the table in regulation 2(2) to regulation 15(5) (as being the provision explaining the meaning of "relevant expenditure" for the purposes of the 1992 Regulations) a reference to regulation 15(4).
    The Regulations substitute for the reference in regulation 5(5) to regulation 5(2) a reference to regulation 5(1) so as to make clear that the reference to any formula in that provision is a reference to the allocation formula in the former maintaining authority's scheme for local management of schools.
    The Regulations also amend regulations 9 and 10. Regulation 9 provides, in any case where the amount of the percentage addition is to be determined under regulation 8, for that amount to be no less than the amount determined in respect of a school for the financial year ending on 31 March 1992. The Regulations amend regulations 9 and 10 so that regulation 9 also applies in any case where the amount of the percentage addition is to be determined under regulation 10.
