Act of Sederunt (Adoption of Children) (Amendment) 1992

Made 28th April 1992
Coming into force 21st May 1992

    The Lords of Council and Session, under and by virtue of the powers conferred on them by section 59 of the Adoption (Scotland) Act 1978([1]), section 32 of the Sheriff Courts (Scotland) Act 1971([2]) and of all other powers enabling them in that behalf, having approved draft rules submitted to them by the Sheriff Court Rules Council in accordance with section 34 of the Sheriff Courts (Scotland) Act 1971 do hereby enact and declare:
    Citation and commencement
        1.—(1)  This Act of Sederunt may be cited as the Act of Sederunt (Adoption of Children) (Amendment) 1992 and shall come into force on 21st May 1992.

        (2)  In this Act of Sederunt a paragraph referred to by number means the paragraph so numbered in the Act of Sederunt (Adoption of Children) 1984([3]).

        (3)  This Act of Sederunt shall be inserted in the Books of Sederunt.
    Amendments
        2.    In paragraph 22—
       (a) after sub-paragraph (1) insert the following sub-paragraph:—
        "  (1A)  When the report of the curator ad litem, in respect of a child who is free for adoption, has been received by the court, the Sheriff may order a diet of hearing to be fixed." ;
       (b) in sub-paragraph (2) after the word "hearing" insert the words "referred to in sub-paragraphs (1) and (1A)".

EXPLANATORY NOTE

(This note is not part of the Act of Sederunt)
    This Act of Sederunt amends the Act of Sederunt (Adoption of Children) 1984 to make provision for a hearing to be fixed in an application for an adoption order under section 12 of the Adoption (Scotland) Act 1978 in respect of a child freed for adoption by an order under section 18 of that Act; and for intimation of the hearing.
