TRADE UNIONS

The Certification Officer (Amendment of Fees) Regulations 1992

Made 2nd March 1992
Laid before Parliament 9th March 1992
Coming into force 1st April 1992

    The Secretary of State, in exercise of the powers conferred by section 7 of the Trade Union (Amalgamations, etc.) Act 1964[1] and now vested in him by the Secretary of State for Employment and Productivity Order 1968[2], and section 8(4) of the Trade Union and Labour Relations Act 1974[3], and section 8(2) of the Employment Protection Act 1975[4] and of all other powers enabling him in that behalf, and as respects regulations 2, 3 and 4 with the approval of the Treasury, hereby makes the following Regulations:
    Citation, commencement and revocation
        1.—(1)  These Regulations may be cited as the Certification Officer (Amendment of Fees) Regulations 1992 and shall come into force on 1st April 1992.

        (2)  The following Regulations are hereby revoked—
       (a) The Certification Officer (Amendment of Fees) Regulations 1981[5];
       (b) The Certification Officer (Amendment of Fees) Regulations 1988[6];
       (c) The Certification Officer (Amendment of Fees) Regulations 1991[7];

    Amendment of fees payable to the Certification Officer
        2.    In paragraph (1) of regulation 11 of the Trade Unions and Employers' Associations (Amalgamations, etc.) Regulations 1975[8] (fees to accompany an application for approval of a proposed instrument of amalgamation or transfer) for the words "£645" there shall be substituted the words "£1241".
        3.    In paragraph (2) of regulation 11 of the Trade Unions and Employers' Associations (Amalgamations, etc.) Regulations 1975 for the words "£15" there shall be substituted the words "£71" (fee on an application for approval of a change of name) and for the words "£3" there shall be substituted the words "£38" (fee for every inspection on the same day of documents kept by the Certification Officer under the Trade Union (Amalgamations, etc.) Act 1964 relating to one and the same organisation).
        4.    In regulation 12 of the Trade Unions and Employers' Associations (Amalgamations, etc.) Regulations 1975 (fee for the entry of the name of an amalgamated organisation in the lists maintained by the Certification Officer where the name of each of the amalgamating organisations is already so entered) for the words "£12.50" there shall be substituted the words "£110".
        5.    The fee of £288 is hereby prescribed for the purposes of section 8(4) of the Trade Union and Labour Relations Act 1974 (fee on application by an organisation of workers or of employers to have its name entered in the list of trade unions or employers' associations).
        6.    The fee of £448 is hereby prescribed for the purposes of section 8(2) of the Employment Protection Act 1975 (fee on application by a trade union for a certificate of independence).

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations, which come into force on 1st April 1992, increase fees payable to the Certification Officer. The fees are increased as follows:—
      (a) from £645 to £1241 on an application for approval of a proposed instrument of amalgamation or transfer;
      (b) from £15 to £71 on an application for approval of a change of name;
      (c) from £3 to £38 for an inspection of documents kept by the Certification Officer under the Trade Union (Amalgamations, etc.) Act1964;
      (d) from £12.50 to £110 for the entry of the name of an amalgamated organisation in the lists maintained by the Certification Officer where the name of each of the amalgamating organisations is already so entered;
      (e) from £45 to £288 on an application by an organisation of workers or of employers to have its name entered in the list of trade unions or employers' associations maintained by the Certification Officer;
      (f) from £305 to £448 on an application by a trade union for a certificate of independence.
