AGRICULTURE

The Environmentally Sensitive Areas (Pennine Dales) Designation (Amendment) Order 1992

Coming into force 25th February 1992

    Whereas, pursuant to section 18(1) of the Agriculture Act 1986[1] the Minister of Agriculture, Fisheries and Food has by order designated an area in the Pennine Dales as an environmentally sensitive area;
    Now, therefore, the said Minister in exercise of the powers conferred on him by section 18(1) and (4) of the said Act, and of all other powers enabling him in that behalf, with the consent of the Treasury, hereby makes the following Order:—
    Title and commencement
        1.    This Order may be cited as the Environmentally Sensitive Areas (Pennine Dales) Designation (Amendment) Order 1992 and shall come into force on 25th February 1992.
    Amendment of the Environmentally Sensitive Areas (Pennine Dales) Designation Order 1992
        2.    The Environmentally Sensitive Areas (Pennine Dales) Designation Order 1992[2] shall be amended in accordance with article 3 below.
        3.    For article 6 there shall be substituted the following article:
            "6.—(1)  The Minister shall make payments under an agreement at the rate of £125 per annum for each hectare of meadowland to which the agreement relates and at the rate of £90 per annum for each hectare of land other than meadowland to which the agreement relates.

            (2)  Where an agreement includes the additional provisions specified in Schedule 2 or Schedule 3, the Minister shall make payments at the rate of £210 per annum for each hectare of meadowland which under the agreement is subject to the provisions of Schedule 2, and at the rate of £25 per annum for each hectare of managed woodland which under the agreement is subject to the provisions of Schedule 3.

            (3)  Where an agreement includes one or more of the conservation plan operations specified in Schedule 4, the Minister shall make payments according to the operations which are carried out at a rate not exceeding £100 per annum for each hectare of land to which the agreement relates, subject to a maximum of £3,000 per agreement." .

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends the Environmentally Sensitive Areas (Pennine Dales) Designation Order 1992 which designates an area in the Pennine Dales as an environmentally sensitive area. The Order amends rates of payment which are applicable in relation to management agreements made under section 18(3) of the Agriculture Act 1986 in respect of agricultural land in the designated area. The rates for land other than meadowland and for additional payment where meadowland is cultivated without the use of fertilisers are increased (from £70 to £90 per hectare, and from £200 to £210 per hectare, respectively) and the rate for meadowland not subject to additional provisions is reduced (from £140 to £125 per hectare). The ceiling for payments under a conservation plan is reduced (from £4,000 to £3,000) (article 3).
