The International Transport Conventions Act 1983 (Amendment) Order 1992

Coming into force in accordance with Article 1

The Queen's Most Excellent Majesty in Council

    Whereas it appears that Her Majesty's Government in the United Kingdom have agreed to the revisions of the Convention which are set forth in Part I of the Protocol of Decisions adopted by the Revision Committee constituted by the Convention in the course of its first session held at Berne from 14th to 21st December 1989[1] and in Part I of the Protocol of Decisions adopted by that Committee in the course of its second session held at Berne from 28th to 31st May 1990[2]:
    Now, therefore, Her Majesty, in exercise of the powers conferred by section 8(1) of the International Transport Conventions Act 1983[3] and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—
    Citation and commencement
        1.    This Order may be cited as the International Transport Conventions Act 1983 (Amendment) Order 1992 and shall come into force on the day after the day on which it is made.
    Amendment of the International Transport Conventions Act 1983
        2.    In section 1(3) of the International Transport Conventions Act 1983[3] (which specifies the provisions of the Convention having the force of law), in paragraph (a), after the words "Command Paper 8535" there shall be inserted

        as amended by—
          "(i) Part I of the Protocol of Decisions adopted by the Revision Committee constituted by the Convention in the course of its first session held at Berne from 14th to 21st December 1989, presented to Parliament in 1991 and set out in Command Paper 1690, and
          (ii) Part I of the Protocol of Decisions adopted by that Committee in the course of its second session held at Berne from 28th to 31st May 1990 as so presented and set out in Command Paper 1689." .

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends section 1 of the International Transport Conventions Act 1983 which gives the force of law in the United Kingdom to the Convention concerning International Carriage by Rail signed on behalf of the United Kingdom on 9th May 1980 (Cmnd. 8535). The Order takes account of amendments to the Convention made by the Revision Committee constituted by Article 8 of the Convention. These amendments were made under Article 20(3) and have come into force for the United Kingdom in accordance with Article 21.
