ROAD TRAFFIC

The Road Traffic Act 1991 (Commencement No. 2) Order 1992

The Secretary of State for Transport, in exercise of the powers conferred by section 84 of the Road Traffic Act 1991^[1] and of all other enabling powers, hereby makes the following Order:—

Citation and Interpretation
    1.    This Order may be cited as the Road Traffic Act 1991 (Commencement No. 2) Order 1992.

    2.    In this Order, "the 1991 Act" means the Road Traffic Act 1991.

Commencement provisions
    3.—(1)  Section 35 of the 1991 Act shall come into force on 2nd March 1992, in so far as it is not already in force.

    (2)  The following provisions of the 1991 Act shall come into force on 1st April 1992—
 (a) section 48, to the extent necessary for the bringing into force of the provision referred to in sub-paragraph (b) below; and
 (b) paragraph 102 of Schedule 4.

Transitional provisions relating to fixed penalty offences
    4.    Paragraph 102 of Schedule 4 to the 1991 Act shall not apply to an offence alleged to have been committed before 1st April 1992.

This Order brings into force on 2nd March 1992, the provisions of section 35 of the Road Traffic Act 1991 which have not previously been brought into force. Those provisions relate to the display of disabled persons' badges.

It also brings into force on 1st April 1992, paragraph 102 of Schedule 4 to that Act. That paragraph amends the Road Traffic Offenders Act 1988 (c. 53) by substituting a new section 53. Section 53 relates to fixed penalties.

The Order contains a transitional provisionso that the above amendment to the Road Traffic Offenders Act 1988 will not apply to offences alleged to have been committed before 1st April 1992.

The provisions of the Road Traffic Act 1991 listed below were brought in to force on 1st October 1991 by the Road Traffic Act 1991 (Commencement No. 1) Order 1991 (S.I. 1991/2054).
