LAND CHARGES

The Local Land Charges (Amendment) Rules 1992

Made 6th February 1992
Laid before Parliament 7th February 1992
Coming into force 1st March 1992

    The Lord Chancellor, in exercise of the powers conferred on him by section 14 of the Local Land Charges Act 1975[1] and with the concurrence of the Treasury as to fees, hereby makes the followng Rules:
        1.    These Rules may be cited as the Local Land Charges (Amendment) Rules 1992 and shall come into force on 1st March 1992.
        2.    For Schedule 3 to the Local Land Charges Rules 1977[2] there shall be substituted the following Schedule:

        1. Registration of a charge in Part II of the register 54.00
        2. Filing a definitive certificate of the Lands Tribunal under rule 10(3) 1.90
        3. Filing a judgment order or application for the variation or cancellation of an entry in Part II of the register 5.70
        4. Inspection of documents filed under rule 10 in respect of each parcel f land 1.90
        5. Personal search in the whole or in part of the register and in addition, in respect of each parcel of land above one, where under rule 11(3) the search extends to more than one period, subject to a maximum £13.00 0.70
        6. Official search (including issue of official certificate of search)—
        (a) in any one part of the register 1.70
        (b) in the whole of the register 4.40
        and in addition, in respect of each parcel of land above one, where under rule 11(3) more than one parcel is included in the same requisition (whether the requisition is for a search in the whole or any part of the register), subject to a maximum of £13.00 0.70
        7. Office copy of any entry in the register (not including a copy or extract of any plan or document files pursuant to these Rules) 1.20
        8. Office copy of any plan or other document filed pursuant to these Rules such reasonable fee as may be fixed by the registering authority according to the time and work involved

        3.    The Local Land Charges (Amendment) Rules 1989[3] are hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Rules)
    These Rules increase the fees payable in connection with the registration of local land charges. The increases range between 16.6% and 21.5%
    The last fee increase took effect on 1st July 1989.
