HIGHWAYS, ENGLAND AND WALES

The A564 Trunk Road Stoke—Derby Route (Foston—Hatton—Hilton Bypass) (Detrunking) Order1992

Made 3rd February 1992
Coming into force 14th February 1992

    The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980[1], and now vested in him[2], and of all other enabling powers:—
        1.    As from the date on which the Secretary of State notifies the County Council of Derbyshire that the new trunk roads are open for through traffic, the lengths of the A50 Trunk Road and the A516 Trunk Road described in Parts 1 and 2 of the Schedule to this Order, and shown by broad striped hatching on the deposited plan, shall cease to be trunk roads and the lengths described in Part 2 of that Schedule shall be classified as specified therein.
        2.    In this Order—
       (a) subject as mentioned in the Schedule all measurements of distance are measured along the route of the relevant highway;
       (b) 
         (i) "classified road"as a classification for a highway, means that the highway is not a principal road for the purpose of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enact-ment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;
         (ii) "the deposited plan"means the plan numbered HA10/EM 65 marked "The A564 Trunk Road Stoke—Derby Route (Foston—Hatton—Hilton Bypass) (Detrunking) Order 1992", signed by authority of the Secret-ary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;
         (iii) "the new trunk roads"means the highways to be constructed by the Secretary of State in pursuance of the A564 Trunk Road Stoke—Derby Route (Foston—Hatton—Hilton Bypass and Slip Roads) Order 1992;
         (iv) "principal road"as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enact-ment and instrument which refers to highways classified by the Secretary of State;
         (v) "the A50 Trunk Road" means the Nottingham—Stoke-on-Trent Trunk Road (A50); and
         (vi) "the A516 Trunk Road" means the Nottingham—Stoke-on-Trent Trunk Road (A516).
        3.    This Order shall come into force on 14th February 1992 and may be cited as the A564 Trunk Road Stoke—Derby Route (Foston—Hatton—Hilton Bypass) (Detrunking) Order1992.
