PUBLIC PASSENGER TRANSPORT

The Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) (Amendment) Regulations 1992

The Secretary of State for Transport, in exercise of the powers conferred by sections 92(2), 105 and 108(1)^[1] of the Road Traffic Act 1988^[2], and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

    1.    These Regulations may be cited as the Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) (Amendment) Regulations 1992 and shall come into force on 1st March 1992.

    2.    Regulation 6 (Disabilities) of the Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) Regulations 1990^[3] shall be amended by the substitution for paragraph (1)(b)(ii) of the following paragraphs—
"(ii) in the case of a person who did not hold an existing licence on 1st January 1983 but who held a licence or an existing licence on 1st March 1992, the visual acuity is worse than 6/9 in the better eye and worse than 6/12 in the other eye and, if corrective lenses are worn, the uncorrected acuity in each eye is worse than 3/60, or

(iii) in any other case, the visual acuity is worse than 6/9 in the better eye or worse than 6/12 in the other eye or, if corrective lenses have tobe worn to ensure that the visual acuity in one eye or both eyes is no worse than 6/9 in the better eye and 6/12 in the other eye, the uncorrected acuity in each eye is worse than 3/60;" .

These Regulations amend regulation 6 of the Motor Vehicles (Driving Licences) (Large Goods and Passenger-Carrying Vehicles) Regulations 1990 so that a person who has abnormal sight in one or both eyes and who does not fall within sub-paragraph (i) of regulation 6(1)(b) has a relevant disability for the purposes of the Road Traffic Act 1988 if—
(a) in the case of a person who, on the coming into force of these Regulations, holds a licence entitling him to drive large goods or passenger-carrying vehicles—
(i) the visual acuity in his better eye is worse than 6/9, and

(ii) the visual acuity in his poorer eye is worse than 6/12, and

(iii) in the case of a person who wears glasses or contact lenses, the uncorrected acuity in each of his eyes is worse than 3/60;

(b) in any other case—
(i) the visual acuity in his better eye is worse than 6/9, or

(ii) the visual acuity in his poorer eye is worse than 6/12, or

(iii) in the case of a person who has to wear glasses or contact lenses to ensure that the visual acuity in his better eye is no worse than 6/9 and/or that the visual acuity in his poorer eye is no worse than 6/12, the uncorrected acuity in each of his eyes is no worse than 3/60.
