The Emulsifiers and Stabilisers in Food (Amendment) Regulations 1992

    The Minister of Agriculture, Fisheries and Food, the Secretary of State for Health and the Secretary of State for Wales, acting jointly, in relation to England and Wales, and the Secretary of State for Scotland in relation to Scotland, in exercise of the powers conferred on them by sections 4(1), 6(4), 16(1)(a) and (e) and (3), 26(1) and (3) and 48(1) of, and paragraph 1 of Schedule 1 to, the Food Safety Act 1990[1], and of all other powers enabling them in that behalf, hereby make the following Regulations, after consultation in accordance with section 48 of the said Act with such organisations as appear to them to be representative of interests substantially affected by the Regulations:—
    Title and commencement
        1.    These Regulations may be cited as the Emulsifiers and Stabilisers in Food (Amendment) Regulations 1992 and shall come into force on 10th March 1992.
    Interpretation
        2.    In these Regulations "the English and Welsh Regulations" means the Emulsifiers and Stabilisers in Food Regulations 1989[2] and "the Scottish Regulations" means the Emulsifiers and Stabilisers in Food (Scotland) Regulations 1989[3].
    Amendment of the English and Welsh and the Scottish Regulations
        3.    In Part II of Schedule 1 to, respectively, the English and Welsh Regulations and the Scottish Regulations there shall be added, after the words "Council Directive 78/663/EEC" in the entries relating to E407 Carrageenan, E466 Carboxymethylcellulose and E473 Sucrose esters of fatty acids, in each case, the words "as amended by Article 1 of Commission Directive 90/612/EEC"[4].

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations, which apply to Great Britain, come into force on 10th March 1992.
    The Regulations amend the Emulsifiers and Stabilisers in Food Regulations 1989 and the Emulsifiers and Stabilisers in Food (Scotland) Regulations 1989 by specifying that the purity criteria for carrageenan, carboxymethylcellulose and sucrose esters of fatty acids given in Part II of Schedule 1 to both sets of Regulations are those contained in Council Directive 78/663/EEC as amended by Commission Directive 90/612/EEC (OJ No. L326, 24.11.90, p.58) (regulation 3).
