The Chester and Halton Community National Health Service Trust (Transfer of Trust Property) Order 1992

Made 28th January 1992
Laid before Parliament 3rd February 1992
Coming into force 24th February 1992

    The Secretary of State for Health, in exercise of the powers conferred by section 92(1) of the National Health Service Act 1977[1] and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of establishments and facilities formerly managed by Halton Health Authority resulting from the establishment of the Chester and Halton Community National Health Service Trust[2], having consulted that Health Authority and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:
    Citation, commencement and interpretation
        1.—(1)  This Order may be cited as the Chester and Halton Community National Health Service Trust (Transfer of Trust Property) Order 1992 and shall come into force on24th February 1992.

        (2)  In this Order:
      "the Authority" means Halton Health Authority;

      "the Trust" means the Chester and Halton Community National Health Service Trust;

      "the trust property" means the items specified in schedules of trust property prepared by and agreed upon by the Authority and the Trust before the date on which this Order is made, which schedules have been signed on behalf of both the Authority and the Trust.

    Transfer of Trust Property
        2.    On 24th February 1992 the trust property shall be transferred from the Authority to the Trust.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order transfers to the Chester and Halton Community National Health Service Trust on 24th February 1992 trust property formerly held by Halton Health Authority. A copy of the schedules of trust property to which the Order refers can be obtained from the Department of Health, National Health Service Trust Unit, Richmond House,79 Whitehall, London, SW1A 2NS.
