TRACTORS

The Agricultural or Forestry Tractors and Tractor Components (Type Approval) (Amendment) Regulations 1992

Coming into force 10th February 1992

    The Secretary of State for Transport, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to any type approval scheme for agricultural or forestry tractors and their components, in exercise of the powers conferred on him by the said section 2(2) and of all other enabling powers, hereby makes the following Regulations:-
    Citation and commencement
        1.—(1)  These Regulations may be cited as the Agricultural or Forestry Tractors and Tractor Components (Type Approval) (Amendment) Regulations 1992 and shall come into force on 10th February 1992.

        (2)  In these Regulations, "the Minister" means the Minister of Agriculture, Fisheries and Food.
    Amendments to Regulations
        2.    In regulation 3(1) of the Agricultural or Forestry Tractors and Tractor Components (Type Approval) Regulations 1988[3], for the definition of "Minister" there shall be substituted the following definition-

        ""Minister" means the Secretary of State;"
    Transitional
        3.    These Regulations do not affect the validity of anything done by or in relaton to the Minister before the coming into force of these Regulations, and anything which at the time of the coming into force of these Regulations is in process of being done under the 1988 Regulations by or in relation to the Minister may be continued by or in relation to the Secretary of State.

EXPLANATORY NOTE

(This note is not part of the Regulations)
        1.    The Agricultural or Forestry Tractors and Tractor Components (Type Approval) Regulations 1988 provide, as required by Council Directive 74/150 EEC (OJ No. L 84, 28.3.74, p 10), for the type approval of certain agricultural or forestry tractors and tractor components which conform to the requirements of certain Council Directives with respect to design, construction, equipment and marking of tractors and tractor components.
        2.    These Regulations amend the 1988 Regulations so that the functions previously performed by the Minister of Agriculture, Fisheries and Food will now be performed by the Secretary of State.
        3.    These Regulations also contain transitional provisions.
